PC RES 1988-059 P.C. RESOLUTION NO. 88 - 59 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 215 FOR A WALL AT 29413 BAYEND DRIVE. WHEREAS , John and Kyriakoula Abazis requested a Variance to allow an existing wall which exceeds the maximum allowed height and is located within the twenty ( 20) foot setback at 29413 Bayend Drive . WHEREAS , after notice pursuant to the City's Development Code, a hearing was held on October 25 , 1988 , at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS : Section 1 : That there are exceptional or extraordinary circumstances or conditions applicable to the property since the wall has been existing for at least 12 years prior to annexation of the Eastview area. Section 2: That a Variance is necessary to preserve or allow the enjoyment of a substantial property right of the applicant which is possessed by other property owners under similar conditions in the same zoning district , since the wall is consistent with walls on other similar properties in the neighborhood. Section 3 : That the granting of the Variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located, since the structure blends with the architecture of the residence and Building and Safety code requirements shall be met . Section 4: That the granting of the Variance will not be contrary to the objectives of the General Plan, as there are no negative impacts since the wall and existing landscaping enhances the physical and visual character of the property and neighborhood. Section 5 : For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 215 , pursuant to the conditions in Exhibit "A" , such conditions being necessary to preserve and protect the public health, safety and welfare . Resolution No. 88-59 Page 2 EXHIBIT "A" Conditions of Approval 1 . The existing wall shall be maintained with its existing colors and materials (tan slumpstone, natural brick, and black ornamental iron) , and may not exceed a height of four feet seven inches (wall) and six feet seven inches (pilasters) . All measurements are from grade adjacent to the street-site of the wall. 2. The existing wall shall be subject to the provisions of Section 17 .68.060 (A-E) of the Rancho Palos Verdes Development Code (non conforming structures) . 3. The existing wall shall conform to all Building and Safety Code requirements within 90 days of Planning Commission \.approval. 4. The existing landscaping in the front yard shall be properly maintained so as to soften the visual impact of the wall. 5 . The applicant shall indicate in writing within 30 days of Planning Commission approval , that all conditions of approval have been accepted. P.C . Resolution No. 88-59 Page 3
