PC RES 1988-045P.C. RESOLUTION NO. 88-45 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 201 AND APPROVING EXTREME SLOPE PERMIT NO. 7 AT 30023 KNOLLVIEW DRIVE. WHEREAS, Randy E. Robinson has requested a Variance and an Extreme Slope Permit for an existing deck over an extreme slope at 30023 Knollview Drive; and WHEREAS, after notice pursuant to the City's Development Code public hearings were held on June 14, and July 26„ 1988, at which time all interested parties were given an opportunity to be heard and present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section l: That such Variance is not necessary because there are no exceptional or extraordinary circumstances or conditions that exist relative to this property which do not apply generally to other properties in the same district in that the property has an extreme slope along the rear and side yards as do other properties in the vicinity. Section 2: That such Variance is not necessary for the preservation and enjoyment of a substantial property right of the applicant which right is possessed by others under like circumstances in the same zoning district since other properties would also be limited to an Extreme Slope Permit for deck construction in an extreme slope. Section 3: That the granting of an Extreme Slope Permit for the deck would not result in adverse effects on neighboring properties because the deck does not obstruct other properties views and is so conditioned to minimize slope intrusion. Section 4: That the granting of such Extreme Slope Permit is consistent with the objectives of the General Plan and the Natural and Urban Overlay Districts that limit deck encroachment into extreme slope areas. Section 5: That the granting of an Extreme Slope Permit is consistent with the Development Code in that there are no other reasonable locations to construct a deck in the rear yard and that there will be insignificant disturbance to the slope. Section 6: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby denies 0, i Variance No. 201, and approves Extreme Slope Permit No. 7 subject to the conditions contained in attached Exhibit "A". This action has been deemed necessary to promote the public health, safety and welfare of the area. The owner shall provide a soils report as deemed necessary by the Building Official and obtain a building permit for the existing deck. Any recommendations determined by the Building Official shall be complied with. 2.
