PC RES 1988-038 P.C. RESOLUTION NO. 88-38 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES GRANTING A NEGATIVE DECLARATION (ENVIRONMENTAL ASSESSMENT NO. 551 ) , AND APPROVING COASTAL PERMIT NO. 54 AND GRADING APPLICATION NO. 1135 FOR THE APPROVAL OF A STORM DRAIN SYSTEM IN KLONDIKE CANYON LOCATED AT THE 5000 BLOCK OF PALOS VERDES DRIVE SOUTH. WHEREAS , the Klondike Canyon Geologic Hazard Abatement District and the City of Rancho Palos Verdes have requested approval of a Coastal Permit and a Grading Application to construct a 1000 foot storm drain system in Klondike Canyon located at the 5000 block of Palos Verdes Drive South. WHEREAS , after notice issued pursuant to the provisions of the City's Development Code , a hearing was held on June 14, 1988 at which time all interested parties will be given an opportunity to be heard and to present evidence . NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND , DETERMINE AND RESOLVE AS FOLLOWS : Section 1 : That the proposed project, with safeguards and conditions imposed by this approval , will cause no significant adverse effects to adjacent properties or the permitted uses thereof. Further , the Planning Commission does hereby declare that a Negative Declaration was granted in compliance with City and State guidelines and that the Commission has reviewed and considered the contents of the initial study in reaching its decision. The Planning Commission further finds that the adoption of the Negative Declaration and the approval of a Coastal Permit and Grading Application will not result in a significant adverse environmental impact. Section 2 : The proposed development is in conformance with the General Plan, RS-1 Zoning Provisions and Coastal Specific Plan. Section 3 : The proposed development, which is located - between the sea and the first public road , is in conformance with the applicable public access and recreation policies of the Coastal Act . Section 4 : The grading is not excessive beyond that necessary for the permitted primary use . Section 5 : The grading and/or construction does not significantly adversely affect the visual relationships with, nor the views from, neighboring sites . Section 6 : The nature of the grading minimizes disturbance to the natural contours ; finished contours are reasonably natural . Section 7 : For the foregoing reasons , the Planning Commission of the City of Rancho Palos Verdes hereby adopts a Negative Declaration (Environmental Assessment No . 551 ) , and approves Coastal Permit No . 54 and Grading Permit No . 1135 , subject to the conditions of approval in Exhibit "A" , which are necessary to protect the public health, safety and general welfare in the area and will make possible development of the City in an orderly and efficient manner and in conformity with the intent and purposes set forth in the Development Code and the Coastal Specific Plan. Resolution No . 88- 38 Page 2 EXHIBIT "A" Conditions of Approval Coastal Permit No. 54 and Grading Application No. 1135 *1. The project shall comply with measures set forth in the Geological Soils Investigation Report prepared by Robert Stone and Associates dated February 4, 1988. *2. The pipe shall be maintained in a clean and obstructive free condition by the City of Rancho Palos Verdes and the Klondike Canyon Geologic Hazard Abatement District. *3. The proposed structure shall include a caged entrance at the beach outlet to prevent persons or animals from entering into it. Such cage shall be openable only by the maintenance parties or public emergency agencies. *4. Where placed on the beach, the headwalls and wingwalls shall not have more than 2 feet exposure as measured from the outside exterior of these walls. The fencing height shall not exceed four feet above the concrete wall. *5. The color of the exterior portions of the facility, which included the gunite, headwalls and wingwalls shall be tan to blend with the existing environmental setting. Actual color mix shall be approved by the Director of Environmental Services prior to construction. 6. A landscape plan shall accompany the improvement plans to provide the re-establishment of native plant materials in all areas that are to be graded. 7. The access road shall be gated or cabled closed from Palos Verdes Drive South.
