PC RES 1988-030P.C. RESOLUTION NO. 88 - 30 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 188 (B) FOR AN EXISTING DECK AND STAIRCASE WHICH ENCROACH INTO THE REQUIRED SIDE YARD SETBACK AT 28053 LOBROOK DRIVE. WHEREAS, Mr. Fred Fenger has required a Variance for an existing deck and staircase which encroach into the south side yard on the subject property; and WHEREAS, after notice issued pursuant to the provision of the Rancho Palos Verdes Development Code, a public hearing was held on April 12 and May 10, 1988 at which time all interested parties were given an opportunity to be heard and present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That the Variance for the existing deck and staircase is not necessary in order to provide handicapped access into the residence, since there are other alternatives to provide this access without encroaching into the required setbacks. Section 2; That granting the Variance as proposed would cause materially detrimental effects on the privacy, peace and quiet of the residence located at 28063 Lobrook Drive, immediately to the south of the subject property. Section 3; For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby denies Variance No. 188 (B). PASSED, APPROVED and ADOPTED the 10th day of May, 1988.
