PC RES 1988-028P.C. RESOLUTION NO. 88 - 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 195 AT 31045/65 MARGUERITE DRIVE. WHEREAS, Harold Levitt and Associates have requested a Variance to allow pools, spas, decking and a 362 square foot addition within 25 feet of the Coastal Setback Line at 31045/65 Marguerite Drive; and WHEREAS, after notice pursuant to the City's Development Code public hearings were held on March 22 and April 26, 1988, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are no exceptional or extraordinary circumstances' or conditions that exist relative to this property which do not apply generally to other properties in the same district in that the property is presently vacant and said structures can be reasonably accommodated on the site without such encroachment. Section 2: That such Variance is not necessary for the preservation and enjoyment of a substantial property right of the applicant which right is possessed by others under like circumstances in the same zoning district since other properties would be limited to the same restrictions and setback requirements. Section 3: That the granting of such a Variance would result in adverse effects to the public welfare or the surrounding development patterns because the structures would encroach into areas designated for no new permanent structures and would cause negative visual impacts along the coastline that is intended to remain in natural open space. Section 4: That the granting of such a Variance will be contrary to the objectives of the General Plan and Coastal Specific Plan that discourage development encroachment into the bluff setback areas designated as natural vegetation to protect the coastline. Section 5: For the foregoing reasons, the Planning Commission of—the City of Rancho Palos Verdes hereby denies Variance No. 195.
