P.C. RESOLUTION NO. 88- 23
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES DENYING VARIANCE NO. 192 AT
26703 BASSWOOD AVENUE.
WHEREAS , Perry and Sue Tso have requested a Variance to allow
an existing downslope deck in an extreme slope at 26703 Basswood
Avenue ; and
WHEREAS , after notice pursuant to the City's Development Code
a public hearing was held on April 12 , 1988, at which time all
interested parties were given an opportunity to be heard and
present evidence.
NOW, THEREFORE , THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS :
Section 1 : That there are no exceptional or extraordinary
circumstances or conditions that exist relative to this property
which do not apply generally to other properties in the same
district in that the property has an extreme slope along the rear
yard as do other properties in the vicinity.
Section 2 : That such Variance is not necessary for the
preservation and enjoyment of a substantial property right of the
applicant which right is possessed by others under like
circumstances in the same zoning district since other properties
would also be limited to an Extreme Slope Permit for deck
construction in an extreme slope.
Section 3 : That the granting of such a Variance would result
in adverse effects to the public welfare or the surrounding
development patterns because the decks are clearly visible to
surrounding properties and do have negative visual impacts .
Section 4 : That the granting of such a Variance will be
contrary to the objectives of the General Plan that discourage
development encroachment into extreme slope areas designated as
natural vegetation and wildlife habitat.
Section 5 : For the foregoing reasons , the Planning Commission
of the City of Rancho Palos Verdes hereby denies Variance No . 192 ,
and directs the property owner to remove only the decks , but the
existing caissons may remain provided they are screened with
landscaping . The owner shall submit and have approved a
landscaping irrigation plan within 90 days . Such landscaping
shall be installed and decking removed within 180 days .
