PC RES 1988-020 P.C . RESOLUTION NO. 88 - 20
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES DENYING
VARIANCE NO. 196 , AT 6720 VIA CANADA.
WHEREAS , Mike and Kathy White have requested a Variance to
allow a swimming pool within the front 20 foot setback at 6720 Via
Canada .
WHEREAS , after notice pursuant to the City ' s Development
Code, a public hearing was held on April 12 , 1988, at which time
all interested parties were given an opportunity to be heard and
present evidence .
NOW, THEREFORE , THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That there are no exceptional or extraordinary
circumstances or conditions applicable to the size, shape ,
topography, development or location of the subject property.
Section 2 : That a Variance is not necessary to preserve or
allow the enjoyment of a substantial property right of the
applicant which is possessed by other property owners under
similar conditions in the same zoning district , since a pool is an
amenity and an accessory use to the main residential structure .
Section 3 : That the granting of the Variance will be
materially detrimental to the public welfare or injurious to
surrounding properties , since the pool would create an attractive
nuisance , noise and water in public areas , a safety hazard and
visually would not provide a lush open environment .
Section 4 : That the granting of the Variance will be
contrary to the objectives of the General Plan, since it will not
enhance the visual character and physical quality of the
neighborhood and will create a safety hazard .
Section 5 : For the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes hereby denies
Variance No . 196 .
APPROVED and ADOPTED this 12th day of April , 1988 .
