PC RES 1988-016P.C. RESOLUTION NO. 88- 16 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING COASTAL PERMIT NO. 48 AND ADDITIONAL GRADING UNDER GRADING APPLICATION NO 1103 AT THE WESTERN BOUNDARY OF THE PORTUGUESE BEND CLUB. WHEREAS, on January 19, 1988 the Portuguese Bend Club Homeowner's Association requested City approval for emergency remedial grading, at the western portion of the Portuguese Bend Club along the toe of the Portuguese Bend Landslide, to protect several residences and ensure continuing access to the area via Yacht Harbor Drive; and WHEREAS, on January 20, 1988 the Director of Environmental Services issued an emergency approval for a coastal permit and grading approval to allow the Association to carry out the emergency remedial grading; and WHEREAS, the Association did not need to remove as much earth to eliminate the emergency as the Director's approval authorized; however, the Association requests advance approval to carry out the remaining grading in the future if necessary for landslide abatement; and WHEREAS, a public hearing on this request for advance authorization to do additional grading was held before the Planning Commission on March 22, 1988, at which time all interested parties were given the opportunity to attend and present testimony. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That the proposed project is consistent with the Coastal Specific Plan since: a) the project is necessary to prevent the deterioration and destruction of the coastal zone. b) the project is necessary to prevent the damage or destruction of at least four single family residences with the Portuguese Bend Club. Section 2: That the proposed project is in conformance with applicable public access and recreation policies of the Coastal Act since the project involves excavation of earth at the toe of an active landslide and does not interfere in any way with coastal access. Furthermore, the project preserves 110 shoreline access for residents of the Portuguese Fend Club by ensuring the continuing accessibility of Yacht Harbor Drive . Section 3 : That the Planning Commission has reviewed and considered the contents of Environmental Assessment No. 544 prior to taking action on these applications and determined that a Negative Declaration should be issued. Section 4 : For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves the issuance of a Negative Declaration and approves Coastal Permit No . 48 and additional grading under Grading Application No. 1103 pursuant to the conditions in Exhibit 'A' attached hereto and necessary for the protection of the public health, safety, and welfare . Resolution No. 88-16 Page 2 EXHIBIT 'A' Conditions of Approval for Coastal Permit No. 48 1. All recommendations of the City's consulting Engineer and Geologist for the landslide shall be incorporated into the project prior to issuance of permits. 2. All recommendations of the City Engineer shall be incorporated into the project prior to the issuance of permits. 3. Grading permits shall be obtained from the Building and Safety Division prior to commencement of the project. 4 The applicant shall record a hold harmless agreement in favor of the City prior to the issuance of any permits. 5. This approval shall expire on March 22, 1989. 6. Any grading over 8000 cubic yards shall be reviewed and approved by the Planning Commission unless an emergency situation arises, in which case, the Director of Environmental Services is authorized to approve additional grading. 7 Haul routes for exported materials shall be approved in advance by the Director of Public Works.
