P . C. RESOLUTION NO. 88- 14
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING VARIANCE
NO. 186 FOR AN EXISTING STAIRCASE OVER 30 INCHES
IN HEIGHT WHICH ENCROACHES INTO AN EXTREME SLOPE
AND IS WITHIN THE REQUIRED SIDE YARD SETBACK AT
28087 ELLA ROAD.
WHEREAS, Mary Lou and A. Zettler Greely have requested a
Variance for an existing staircase at 28087 Ella Road ; and
WHEREAS, after notice issued pursuant to the provision of the
Rancho Palos Verdes Development Code, a public hearing was held on
January 26 , 1988 and March 8 , 1988 at which time all interested
parties were given an opportunity to be heard and present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That there are exceptional or extraordinary
circumstances or conditions applicable to the property involved
which do not apply generally to other properties in the same
zoning district; in that the property lines do not extenddown the
slope to San Nicolas and access to the bench drain is only
available from above.
Section 2 : That said Variance is necessary for the
preservation and enjoymentof a substantial property of the
applicant, which right is possessed by other property owners under
like conditions in the same zoning district, in that the existing
staircase is necessary to allow annual cleaning of the bench
drain.
Section 3 : That the Variance will not have a materially
detrimental effect on surrounding properties since the landowner
is required to submit a landscape plan to screen the structure,
subject to the review and approval of Director of Environmental
Services .
Section 4 : That the Variance is not contrary to the General
Plan. �w
Section 5 : For the foregoing reasons , the Planning Commission
of the City of Ranchc Palos Verdes hereby approves Variance No .
186 .
PASSED, APPROVED and ADOPTED the 22nd day of March, 1988 .
