PC RES 1988-011 P.C. RESOLLTION NO. 88-•11 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES RECOMMENDING APPROVAL OF A NEGATIVE DECLARATION FOR ENVIRONMENTAL ASSESSMENT NO. 537 AND RECOMMENDING ADOPTION OF DEVELOPMENT CODE AMENDMENT NO . 25 . WHEREAS , the City has initiated Code Amendment No . 25 , Recycling , October 20 , 1987 to establish procedures and standards for the placement or construction of recycling facilities within commercial or institutional zones in the City in response to state legislation mandating local placement of recycling facilities . WHEREAS, the Planning Commission has held public hearings on this matter on November 24 , 1987 and on January 26 , February 23 , and March 8 , 1988 at which time all interested parties were given an opportunity to be heard and present evidence . WHEREAS, the Planning Commission has considered the contents of the Initial Study for Environmental Assessment No . 537 prior to recommending that Negative Declaration be issued . WHEREAS , the Code revision is necessary to ensure that recycling facilities are installed in locations that do not impair the health , safety, and welfare of the community. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY RECOMMEND TO THE CITY COUNCIL AS FOLLOWS: Section 1 : That the Code revisions are necessary to amend the language of the Development Code in response to state legislation enacted which mandates local placement of recycling facilities . Section 2: That draft Negative Declaration for Environmental Assessment No. 537 should be issued, as there are no negative impacts for the Code Ammendment. Section 3 : That the Code revisions are consistent with the intent of the General Plan as they minimize the effects that recycling centers can have on the health, safety and welfare of the community. Section 4 : For the foregoing reasons , the Planning Commission of the City of Rancho Palos Verdes hereby recommends approval of the Draft Negative Declaration and Development Code Amendment No . 25 pursuant to Exhibit "A" attached . Resolution No . 88- 11 Page 2 EXHIBIT "A" CODE AMENDMENT NO. 25 Section 16 .04 . 1105 of Chapter 16 . 04 of the Rancho Palos Verdes Code is amended to add: 16.04.1105 Single feed reverse vending machine . "Single feed reverse vending machine" means an automated, mechanized device which accepts one or more types of empty beverage containers, including, but not limited to aluminium cans , glass, and plastic bottles , one at a time, for sorting and mechanical processing entirely within the machine . Section 16.04 . 1124 of Chapter 16 . 04 of the Rancho Palos Verdes Code is amended to add: 16.04 .1124 Small collection facility. "Small collection facility" means a center, occupying an area not exceeding 500 square feet, for the acceptance, donation, redemption, or purchase of recyclable materials from the public . Such facilities include bulk feed reverse vending machines, one or more single feed reverse vending machines occupying an area greater than fifty ( 50 ) square feet, attended or unattended drop-off collection areas and structures , kiosk or igloo type collection units, mobile collection facilities, and any structural enclosures for these facilities . Power driven processing equipment is not permitted except as designed within reverse vending machines . The title of Chapter 17 .63 of the Rancho Palos Verdes Municipal Code is amended to read as follows : Chapter 17 .63 RECYCLING CENTERS . Chapter 17 . 63 introduction index section of the Rancho Palos Verdes Municipal Code is amended to add: 17 .63 .010 Purpose 17 . 63.020 Criteria for evaluation of installation of Single Feed Reverse Vending Machine . 17 .63 .030 Application referred to Planning Commission 17 . 63.040 Appeals Section 17 .63 .010 of the Rancho Palos Verdes Municipal Code is amended to add: 17 .63.010 Purpose . The purpose of this chapter is to establish procedures and standards for the placement or construction of single feed reverse vending machines and small collection facilities within commercial or institutional zones in P. C. Resolution No . 88- 11 Page 3 the City in order to protect the health safety and welfare of the community. 17 .63 .020 Criteria for evaluation of installation of Single Feed Reverse Vending Machine . The installation of single feed reverse vending machines outdoors in commercial and institutional zones is permitted subject to site plan review to ensure compliance with the following standards : A. Not more than fifty ( 50) square feet of floor area may be used for any machine, group of machines , and machine enclosure, unless a Conditional Use Permit is obtained. The maximum height of the enclosures shall not exceed twelve ( 12 ) feet. B . Each machine shall be located within thirty ( 30 ) feet of the public entrance to the primary use on site, outside of all required building setbacks, and shall not obstruct pedestrian or vehicular circulation nor occupy any parking spaces designated for the primary use . C. Each machine shall be clearly and permanently marked to identify the type of material accepted, operating instructions , and the identity and telephone number of the operator. A maximum of three ( 3 ) square feet of signage for each machine is permitted in addition to operating instructions . Outdoor lighting of the machines is permitted provided that such lighting is shielded to prevent the direct of indirect illumination of adjacent residentially zoned or occupied property. D. Operating hours shall, at a minimum, be concurrent with the operating hours of the primary use on the site . The servicing hours shall be limited to 7 a.m. to 7 p.m. Monday through Saturday. The area around the machines must be kept clean and litter free . At least one alternative disposal deviceAmust be located adjacent to each machine or group of machines to control any accumulation of trash if the facility becomes overloaded or broken. E . In addition to the enforcement authority prescribed by Chapter 17 . 70 of the Development Code, the Director of Environmental Services may revoke approval for any machine and cause its removal as a public nuisance pursuant to Chapter 8 . 12 of the Municipal Code for violation of any of the above standards . F. The facility shall be located conveniently to a water source and a maintenance schedule shall be submitted and approved by the Director of Environmental Services for proper maintenance to ensure a healthful environment . Section 17 .63 .030 of the Rancho Palos Verdes Municipal Code is amended to add: 17 .63 .030 Application referred to the Planning Commission . The installation of small collection facilities is permitted, P.C. Resolution No. 88- 11 Page 4 subject to approval of a Conditional Use Permit, to ensure that the following standards, as well as the requirements of Section 17 . 56 . 060 (A-F) , are satisfied: A. The facility shall comply with all building setback and lot coverage requirements that would apply to the primary use on the site, and the maximum height of the facility of any enclosure shall not exceed twelve ( 12 ) feet . B. Facility identification signage shall permanent in character and be limited to ten ( 10) percent of the areas of each side of the facility, not to exceed a maximum of fifty ( 50) square feet per site. Signage must be consistent with the character of the location and my be illuminated during the hours of operation, subject to the approval of the Director of Environmental Services . C. Containers and/or reverse vending machines within the facility shall be clearly marked to identify the type of material accepted, operating instruction, the identity and telephone number of the operator, and shall include a notice (no larger than 3 square feet) stating that no material shall be deposited at the facility except if left in an approved container or reverse vending machine. The operating instructions and notices are permitted in addition to the facility identification signage described in Subsection B. D. All recyclable materials deposited at the facility shall be contained entirely within the facility and shall not , at any time, be left outside of the facility in public view. Recycle materials shall be picked up on an approved schedule to prevent accumulation of materials in public views . Pick-ups , or deliveries of empty replacement containers , shall only occur between the hours of 7 a. m. and 7 p. m. , Monday through Saturday. An alternative disposal devi a,,for materials that cannot be accepted by the facility shall be placed adjacent to the facility to discourage dumping and to control any accumulation of trash if the facility becomes overloaded or broken. This device, and the entire facility, shall be monitored daily by the operator to maintain the cleanliness of the site . E . Facilities providing for the 24 hour donation of materials shall be at least one hundred ( 100 ) feet from any property zoned or occupied for residential use, unless a smaller setback is warranted based on adjacent topography or the design of the facility. F. The facility shall be located conveniently to a water source and a maintenance schedule shall be submitted and approved by the Planning Commission for proper maintenance to ensure a healthful environment. G. Attended facilities located within one hundred feet of a property zoned of occupied for residential use shall only operate P .C . Resolution No . 88- 11 Page 5 between the hours of 9 a.m. and 7 p.m. One parking space shall be reserved for the attendant, if necessary. H. If there is no reasonable alternative location for the facility, it may be located in the parking area of the primary use. If the reduction in parking spaces causes the number of available parking spaces to be less than the minimum number required for the primary use, the Planning Commission may reduce parking requirements for the primary use, the Planning commission may reduce parking requirements for the primary use by not more than five ( 5 ) spaces, This reduction shall only be granted under the following conditions : ( 1 ) The facility is located in a convenience zone as designated by the California Department of Conservation. ( 2) A parking study shows that existing parking capacity is not already fully utilized during the time the recycling will be on the site. ( 3 ) There must be a least 25 parking spaces designated for the primary use prior to installation of the facility. I. Operation of the facility shall not increase the ambient noise level at the property line of the nearest property zoned or occupied for residential use to more than 60 dBa at any time . J. Outdoor lighting for the facility is permitted provided that such lighting is shielded to prevent the direct or indirect illumination of adjacent residentially zoned or occupied property. K. The design and location of the facility shall be approved by the Planning commission to ensure that the facility is substantially screened, to the extent practical, from the view of adjacent residentially zoned or occupied property, while remaining clearly identifiable to patrons of the facility. Landscaping, fences, walls, structural enclosures, and/or coloring may be required to accomplish this purpose . L . Enforcement of the conditions of approval for the facility shall occur pursuant to Section 17 . 25 . 060 (A) ( 1-2 ) . M. Approval of a small collection facility shall not be denied unless the Planning Commission cannot make the findings for Conditional Use Permit approval specified in Section 17 . 56 . 060, and specially finds that the facility would be detrimental to public health, safety or welfare . Section 17 .63.040 of the Rancho Palos Verdes Municipal Code is amended to: 17 .63.040 Appeals . The petitioner or any other interested person may appeal any decision or any condition of the director to the planning commission or of the planning commission to the city P .C . Resolution Nu. 86- 11 Page 6 v council by filing a written request, together with an appeal fee as established by resolution of the city council , with the city within fifteen day after the decision is made .
