A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
VARIANCE NO. 190 FOR A ROOM ADDITION AT
NO. 2 DIAMONTE LANE .
WHEREAS, Shalender and Kum kum Bhasin have requested a
Variance to allow an addition which encroaches 8 feet into the
required 20 foot front setback at #2 Diamonte Lane .
WHEREAS , after notice pursuant to the City ' s Development
Code, a public hearing was held on March 8 , 1988, at which time
all interested parties were given an opportunity to be heard and
present evidence .
NOW, THEREFORE , THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That there are exceptional or extraordinary
circumstances or conditions applicable to the property since the
lot is a flag lot and the existing layout of the residence does
not conform to the Development Code property line designations .
Section 2 : That a Variance is necessary to preserve or allow
the enjoyment of a substantial property right of the applicant
which is possessed by other property owners under similar
conditions in the same zoning district , since the addition will
enclose an already existing partially enclosed patio area and not
encroach any further into the front setback than the existing
structure .
Section 3 : That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located, since the structure will cause no view blockage and will
not encroach into the privacy of adjacent neighbors .
Section 4 : That the granting of the Variance will not be
contrary to the objectives of the General Plan, since the addition
as located will enhance the physical and visual character of the
property and neighborhood .
Section 5 : That , as a condition of approval , no windows or
doors are allowed on the east (front) side of the addition.
APPROVED and ADOPTED this 8th day of March, 1988 .
