RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES DENYING ENCROACHMENT PERMIT
NO. 8 FOR AN EXISTING FENCE , GATE, AND PILASTERS AT 29900
AVENIDA ESPLENDIDA.
WHEREAS , Hong Jong Dae has requested an Encroachment Permit
to allow an existing 6 foot fence , gate and pilasters which
encroach into the front 20 foot setback and the public right-of-
way at 29900 Avenida Esplendida .
NOW, THEREFORE , THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That the encroachment is not in the best interest
of the City since it prohibits access to public utilities and
prohibits any future public right-of-way improvements .
Section 2 : That the encroachment will be detrimental to
public health and safety since the main water valves and emergency
shut-offs are located behind the fence.
Section 3 : The encroachment is not necessary by the fact
there is an alternative location on private property for the
fence , gate and pilasters which would eliminate the need to
encroach.
Section 4 : The encroachment exceeds the maximum 42 inch
height limit for an encroachment into the right-of-way located
adjacent to the front of the owner ' s property.
Section 5 : For the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes hereby denies
Encroachment Permit No . 8.
APPROVED and ADOPTED this 9th day of February, 1988 .
