NO. 87 - 62 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 173 FOR A SOLID WALL IN THE FRONT YARD SET- BACK AND APPROVING GRADING NO. 1031 FOR A COMBINATION RETAINING WALL AND FREESTANDING WROUGHT IRON FENCE IN THE FRONT YARD SETBACK AT 1887 MACARTHUR STREET. WHEREAS, Mr. Gavrilo Cucuk has requested a Variance and Grading Permit for an existing combination retaining wall/solid freestanding wall located within the front yard setback; and WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held on October 27, 1987, at which time all interested parties were given an opportunity to be heard and present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are no the size, shape and topography of generally found on other lots in the subject property is a typical the Eastview area. special circumstances related to the property which are not the same zoning district, since graded pad lot found throughout Section 2: That there are no special circumstances which unreasonably restrict the applicant's ability to develop the property in conformance with City development regulations, in that Section 17.42.030 of the Development Code permits a wall up to 42 inches and a fence up to 6 feet in the front yard setback subject to the approval of the Director of Environmental Services or the Planning Commission. Section 3: That approval of the Variance will confer a special privilege on the applicant in relation to similarly situated property owners in the same zoning district, in that there are alternative designs for the wall which would comply with Code requirements. Section 4: That approval of the Variance will cause materially detrimental effects on surrounding properties, in that the solid wall adjacent to the street would have an immediate and cumulative negative visual impact on the neighborhood. Section 5: That the Variance request is contrary to the policy of the General Plan aimed at preserving the open and rural character of the City. Section 6: That when modified by the conditions of approval Resolution P.C. No. 87 - 62 Page 1 in Exhibit "A", the project can be approved through a Grading Application. Section 7: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby denies Variance No. 173 for an existing solid wall in the front yard setback which exceeds 6 feet in height and approves Grading No. 1031 for modification of said existing wall, subject to the conditions of approval in Exhibit "A", in the front yard setback located at 1887 MacArthur Street. No. 87 - 62 Page 2 EXHIBIT "A„ GRADING N0. 1031 1. The property owner shall apply for a Minor Exception Permit for modification of the existing wall. 2. The wall shall have a maximum 2 foot 6 inch retaining wall with a maximum 3 foot 6 inch wrought iron fence on top (per Building Code requirement for a handrail) for an overall downslope height of 6 feet or less. 3. The landowner shall obtain all necessary building permits for the structure after approval of the Minor Exception Permit. 4. The existing wall shall be modified subject to the approval of the Director of Environmental Services within 60 days of this decision. Resolution P.C. No. 87 -62 Page 3
