PC RES 1987-055 RESOLUTION P.C. NO . 87 - 55
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
VARIANCE NO. 175 FOR A MAID'S ROOM AND
BATHROOM AT 29916 AVENIDA MAGNIFICA.
WHEREAS, Dr. Julius Coleman has requested a Variance to allow
an addition which encroaches 7 feet 6 inches into the required 15
foot rear setback at 29916 Avenida Magnifica .
WHEREAS , after notice pursuant to the City' s Development
Code, a hearing was held on September 22 , 1987 , at which time all
interested parties were given an opportunity to be heard and
present evidence .
NOW, THEREFORE , THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That there are exceptional or extraordinary
circumstances or conditions applicable to the property since the
existing structure is nonconforming and the layout of the floor
plan hinders construction in other areas of the lot .
Section 2 : That a Variance is necessary to preserve or allow
the enjoyment of a substantial property right of the applicant
which is possessed by other property owners under similar
conditions in the same zoning district , since the addition is
located in an area which will preserve existing mature landscaping
and the architectural integrity of the residence .
Section 3 : That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located , since the structure will cause no view blockage and not
encroach into the privacy of adjacent neighbors .
Section 4 : That the granting of the Variance will not be
contrary to the objectives of the General Plan , since the addition
as located enhances the physical and visual character of the
property and neighborhood .
Section 5 : That , as a condition of approval , no windows are
allowed on the east (rear) side of the addition.
Section 6 : That , as a condition of approval , a deed
restriction be recorded prohibiting the addition from being used
as a second unit .
APPROVED and ADOPTED this 22nd day of September , 1987 .
