PC RES 1987-048 RESOLUTION P.C. NO . 87- 4.8 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 169 AT 19 COVEVIEW DRIVE WHEREAS , Mr. Hal Lindsey has requested a Variance for a solid , 6 foot wall within the front yard setback at 19 Coveview Drive; and WHEREAS , after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code , a public hearing was held on August 25 , 1987 at which time all interested parties were given an opportunity to be heard and present evidence; NOW, THEREFORE , THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS : Section 1 : That there are no exceptional or extraordinary circumstances or conditions applicable to the property involved which do not apply generally to other properties in the same zoning district , in that the lot is level and rectangular. Section 2 : That said Variance is not necessary for the preservation and enjoyment of a substantial property right of the applicant , which right is possessed by other property owners under like circumstances, in that there are alternative designs and locations for the wall which would comply with Code requirements . Section 3 : That approval of the Variance will cause materially detrimental effects on surrounding properties, in that the solid wall adjacent to the street would have immediate and cumulative negative visual impact on the neighborhood . Section 4 : That the Variance request is contrary to the policy of the General Plan aimed at preserving the open and rural character of the City. Section 5 : For the foregoing reasons , the Planning Commission of the City of Rancho Palos Verdes hereby denies Variance No . 169 for a 6 foot wall within the front setback at 19 Coveview.
