PC RES 1987-029l RESOLUTION P.C. NO. 87-29 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 161 AND APPROVING CUP NO. 118 AND GR. NO. 1005 FOR A MULTI- PURPOSE/ADMINISTRATION BUILDING. WHEREAS, St. Paul's Lutheran Church, located at 31290 Palos Verdes Drive West, has requested approvals to build a multi-purpose/administration building; and WHEREAS, after notice pursuant to the City's Development Code, public hearings were held on Tuesday June 9 and June 30,1987, at which time all interested parties were given the opportunity to give testimony. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: In denying Variance No. 161, the Planning Commission finds as follows: A. That there are no unusual circumstances or conditions relating to the shape or size of the subject property, which are not applicable to other properties in the same zoning district, in that the proposed building can be located on the site and still meet all setback and parking requirements. B. That approval of a setback Variance would bestow a substantial property right upon the applicants, which right is not enjoyed by other property owners in the same zoning district as it relates to new construction. Section 2: That the proposed use is permitted in the zone subject to the issuance of a Conditional Use Permit. Section 3: That given the site's size, location and adjacent uses, it is adequate to accommodate the proposed 4,484 square foot building, as well as the 79 required parking spaces (27 on-site, 52 on adjacent parcel per parking easement). Section 4: That the site is served by Palos Verdes Drive West, which is designed to carry the type and quantity of traffic generated by the proposed use. Section 5: That the proposed use is in conformity with the General Plan, which designates the site appropriate for the existing use. Section 6: That the proposed use would not result in significant adverse impacts on adjacent properties as the use is conditioned in Exhibit "A", attached hereto and made a part hereof by reference. Section 7: That the proposed use is Categorically Exempt under Section 15301, Class 1 of CEQA. Section 8: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves CUP No. 118 and GR. No. 1005, subject to the conditions contained in Exhibit "A", attached hereto, which are necessary to protect the public health, safety and general welfare. Ortolano Chairperson Resolution P.C. 87- 29 Page 2 J, EXHIBIT "A" CUP NO. 118 AND GR. NO. 1005, ARE APPROVED SUBJECT TO THE FOLLOWING CONDITIONS: 1. The approval of CUP No. 118 and GR. No. 1005 shall expire one year from the date of adoption of this resolution unless application for building permits is made. Extensions may be granted by the Planning Commission if requested in writing prior to expiration. 2. All final site, building, grading, landscaping/ irrigation, and lighting plans shall be reviewed and approved by the Director of Environmental Services prior to issuance of any permits. Building placement, designs, materials, colors and textures shall be in substantial compliance with those on the plans approved by the Planning Commission. 3. The proposed building shall not exceed 3,553 sq. ft. for the main level and 931 sq. ft. for the basement. The maximum height shall not exceed 16' as measured from grade. The minimum south side setback shall not be less than 20'. 4. A complete landscape and irrigation plan for new landscaped areas shall be reviewed and approved by the Director of Environmental Services. Plant materials shall be of low water use varieties; all lighting fixture details shall be shown on this plan. Said fixture shall be shielded so as to not illuminate adjacent properties. 5. A minimum of 79 parking spaces are required. The adjacent gravel parking area shall be rolled and paved with three (3) inches of A.C. paving and shall be stripped for 52, 9'x 20' spaces with 25' driveway aisles. A minimum of 27 spaces shall be provided on-site as per the approved plan. In the event that the owner of the adjacent commercial property, whereon lies said gravel parking lot, should deny the applicant the right to pave said gravel lot, the applicant shall be required to maintain that gravel lot in a neat and orderly fashion and mark it with some other appropriate material to be approved by the Director of Environmental Services. 6. Concurrent use of the sanctuary and the multi-purpose building is prohibited except for existing concurrent activities such as religious school, choir warm- up/practice and administrative offices. A copy of the church's monthly newsletter shall be provided to the Resolution P.C. 87- 29 Page 3 Department of Environmental Services at the beginning of each month starting in the month building permits are finalized. Failure to comply with this schedule shall be grounds for revocation of the Conditional Use Permit. 7. The applicant shall make a cash payment to the City in the amount of $2,635.00 prior to issuance of any permits, to cover the costs of 1 1/2 inch A.C. overlay and stripping and signing of a Class II bicycle path for the property frontage along Palos Verdes Drive West.
