PC RES 1987-0285 RESOLUTION P.C. NO. 87- 28 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING GRADING APPLICATION NO. 979 -APPEAL. WHEREAS, William and Maria Kupferschmidt have requested a Grading application to allow an existing six foot retaining wall in the sideyard in an extreme (66%) slope at 30240 Calle de Suenos. WHEREAS, after notice pursuant to the City's Development Code, a hearing was held on June 9, 1987, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That the existing retaining wall is not contrary to the intent of the Grading Section 17.50.070 of the City's Development Code since it does not cause any negative impact on the public health, safety and general welfare. Section 2: That the granting of the Grading application will not be contrary to the objectives of the General Plan, since it is only 17 feet 6 inches long, is constructed of a material which matches the existing architecture and is barely visible to adjacent properties. Section 3: This approval is invalid unless building and safety approval is obtained. If the existing wall does not meet Building and Safety standards it may be replaced with a similar wall of the same height and width with a similar exterior treatment. No. 87- 28 Page 1 Section 4: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves Grading Application No. 979 -Appeal, subject to the conditions attached in Exhibit "A". No. 87-28 Page 2 EXHIBIT "A" 1. The existing playhouse must be relocated and lowered to conform with the Rancho Palos Verdes Development Code height and setback requirements.
