PC RES 1987-021• RESOLUTION P.C. NO. 87- 21 A RESOLUTION THE CITY OF VARIANCE NO. NO. 23, REV. NO. 991. • OF THE PLANNING COMMISSION OF RANCHO PALOS VERDES APPROVING 155, CONDITIONAL USE PERMIT "0", AND GRADING APPLICATION WHEREAS, Jacques and Susan Allewaert have made application to construct a 34 foot high single-family dwelling at 32415 Aqua Vista. WHEREAS, a public hearing was held on Tuesday June 9, 1987, at which time all interested parties were given an opportunity to testify and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property involved, or to the intended use of the property which do not generally apply to other properties in the same zoning district, as the lot contains unusual and difficult topography. Section 2: That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, which right is possessed by the other owners under like conditions in the same zoning district, as the proposal is similar in size, maximum ridge height and yard area. Section 3: That granting of the variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located as the proposal is designed to fit into the hillside which lessen its visual impact on surrounding properties, and there will be no view impact. Section 4: That the granting of such a variance will not be contrary to the objectives of the General Plan in that it is encouraging reasonable development of the property without impairing the views of neighboring properties or creating any safety hazards and it will enhance the communities quality living environment. Section 5: That the Conditional Use Permit revision is consistent with the intent of the original Conditional use Permit approval. Resolution P.C. No. 87- 21 Page 1 Section 6: That the grading is consistent with the Grading Section of the City's Development Code. Section 7: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby grants Variance No. 155, Conditional Use Permit No. 23, Revision "0" and Grading Application No. 991, subject to the conditions contained in Exhibit "A" attached hereto. A landscape plan consistent with the Seacliff Hills Guidelines must be submitted and approved by the Director of Environmental Services prior to issuance of building permits. 2. Height Variation No. 503 must be reviewed and approved by the Director of Environmental Services. 3. Any other increases in lot coverage, as defined by the Seacliff Hills Guidelines, require a Conditional Use Permit Revision. Resolution P.C. No. 87- 21 Page 3
