PC RES 1987-020 RESOLUTION P.C. NO. 87 - 20
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES
APPROVING VARIANCE NO. 156
WHEREAS , Mr. Jerome Chatow has requested a Variance for
a deck addition to an existing balcony at 6510 Lebec which
will result in a downslope height of the residence exceeding
the 30 foot maximum required by the Development Code; and
WHEREAS , after notice issued pursuant to the provision
of the Rancho Palos Verdes Development Code , a public hearing
was held on May 12 , 1987 at which time all interested parties
were given an opportunity to be heard and present evidence;
WHEREAS , THEREFORE , THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND
RESOLVE AS FOLLOWS:
Section 1 : That there are exceptional or extraordinary
circumstances and conditions applicable to the property
involved which do not apply generally to other properties in
the same zoning district , in that the lot is irregular in
configuration and constrained by unusual topography.
Section 2 : That said Variance is necessary for the
preservation and enjoyment of a substantial property right of
the applicant , which right is possessed by other property
owners under like conditions in the same zoning district , in
that there is no level outdoor dining area which is
accessible from the kitchen and affords a view.
Section 3 : That the existing residence with a downslope
height of 31 feet 10 inches is legal nonconforming and that
the project would not substantially increase the
nonconformity.
Section 4 : That granting said Variance will not cause
materially detrimental effects on surrounding properties , in
that the deck will not impair the views or privacy enjoyed by
surrounding properties .
Section 5 : That approval of said Variance is not
contrary to the General Plan.
Section 6: For the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes does hereby
approve Variance No . 156.
PASSED , APPROVED AND ADOPTED on May 26 , 1987 .
