NO. 87-17 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING AN AMENDMENT TO CONDITIONAL USE PERMIT NO. 92, TO CONSTRUCT A DAY CARE FACILITY, CONVERT THE EXISTING DAY CARE TO CADET HOUSING AND BUILD A PARKING LOT. WHEREAS, the Salvation Army, located at 30840 Hawthorne Boulevard, has requested approval to amend the CUP NO. 92 by constructing a day care building, parking lot, and converting an existing building into a cadet housing on its site within an Institutional Zoning District; and WHEREAS, a public hearing was held on Tuesday, April 28, 1987, at which time all interested parties were given the opportunity to give testimony and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That the 42 acre Salvation Army site is adequate in size and shape to accommodate the proposed building, parking lot, and housing conversion. Section 2: That the site is served by two major arterials, Palos Verdes Drive South and Hawthorne Boulevard, which are designed to carry the type and quantity of traffic generated by the existing use and the proposed structure is not expected to significantly generate additional traffic since it would consolidate existing activities. Section 3: That there will be no significant adverse effects on surrounding property or the permitted uses thereof because the proposed project complies with City Development regulations and because conditions of approval have been added to further reduce any potential adverse effects. Section 4: That the use is not contrary to the General Plan, which designates the site as appropriate for the proposed use. Section 5: That there would-be no significant negative impacts associated with this use, as it has been found to be Categorically Exempt under the provisions of the California Environmental Quality Act. No. 87- 17 Page 1 Section 6: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves Conditional Use Permit No. 92 Amendment, subject to the conditions contained in Exhibit "A", attached hereto, which are necessary to protect and preserve the public health, safety and general welfare of the area. No. 87-17 Page 2 EXHIBIT "A" This amendment to CUP No. 92 is subject to the following conditions: 1. Construction and site development must conform to the approved plans and to all applicable sections of the Rancho Palos Verdes Development and Building Codes. 2. Lighting in any of the proposed parking areas shall be shielded to prevent off-site illumination. Detailed plans shall be submitted to the Director of Environmental Services for review and approval prior to installation. 3. Any change in the use, occupancy, standards and/or criteria for enrollment and/or attendance of the subject day care or cadet housings building shall be documented and may require Planning Commission approval, subject to determination by the Director of Environmental Services. 4. Any existing mature landscaping which is removed must be replaced. 5. A landscape plan for the parking lot and any replacement landscaping must be submitted to and approved by the Director of Environmental Services. 6. The Peninsula Racquet Club located at 30850 Hawthorne Boulevard must submit a letter stating an agreement to allow the Salvation Army to utilize their parking facilities to accommodate overflow parking (for special events). 7. The landowner shall post a cash deposit, bond or a combination thereof in an amount sufficient to cover the center line of the right-of-way on that portion of Hawthorne Boulevard which abuts this property. Said improvements shall be determined by the Director of Environmental Services. The design of such improvements shall be subject to adopted street standards or approval of the Department of Public Works. 8. This Conditional Use Permit Revision shall expire within one year of this approval unless building permits are issued or an extension is granted by the Planning Commission prior to expiration. The following parking and loading spaces are to be provided in a location approved by the Director of Environmental Services: Parking Spaces - 15 - 9'x 20' parking spaces Loading - 1 - 10' x 20' x 14 vertical height Passenger Loading- 25' length of curb. 10. Any proposed air conditioning or heating units shall be muffled to achieve a maximum 60 dB(A) decibel level at the north property line. This shall be verified by a field test prior to issuance of certificates of occupancy. 11. The existing air conditioning and heating units be retrofitted with sound muffling devices to achieve a decibel level of 60 dB(A) or less, at the north property line, to be verified by field test.
