PC RES 1987-009 RESOLUTION PC NO. 87- 9 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES RECOM- MENDING ADOPTION OF CODE AMENDMENT NO. 23 WHICH DEFINES CONVENIENCE STORES, CLASSI- FIES THEM AS CONDITIONAL USES IN THE COM- MERCIAL GENERAL, COMMERCIAL NEIGHBORHOOD, AND COMMERCIAL LIMITED ZONES, AND ESTAB- LISHES STANDARDS AND GUIDELINES FOR THEIR REVIEW. WHEREAS , the City Council, in response to public concern about the uncontrolled proliferation of convenience stores, enacted a moratorium temporarily preventing further development of convenience stores in April 1986, and requested staff and the Planning Commission to study this issue and make recommendations for further action. WHEREAS, in September, October, and November 1986, staff and the Planning Commission held two workshops, and one informal hearing, which included participants representing food and fuel retailers , law enforcement, homeowners , and merchants, to prepare a recommendation to the City Council . WHEREAS , in December 1986 the City Council reviewed the recommendation for action prepared by staff and the Planning Commission, and voted to initiate Code Amendment No. 23 to amend the Development Code as recommended. WHEREAS, the Planning Commission has considered the contents of the Initial Study for Environmental Assessment No. 502. WHEREAS, the Planning Commission held duly noticed public hearings on January 13 and January 27 , 1987 at which time all interested parties were given an opportunity to be heard and to present evidence. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY RECOMMEND TO THE CITY COUNCIL AS FOLLOWS : Section 1: That the proposed Code Amendment is necessary to define, classify, and regulate convenience stores to forestall adverse effects on the public health, safety, and welfare, and the environment relating to: circulation, security, compatibility with adjacent land uses, economic diversity, joint sale of alcoholic beverages and motor fuel, and aesthetics . Section 2 : That a draft Negative Declaration has been issued for the project. Section 3 : That the Code Amendment is consistent with the intent of the General Plan. Section 4 : That for the foregoing reasons , the Planning Commission of the City of Rancho Palos Verdes hereby recommends approval of the draft Code Amendment No . 23 attached hereto.
