PC RES 1987-005 1110 RESOLUTION P.C. NO. 87 -
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DENYING VARIANCE NO. 149 AT 4401 PALOS VERDES
DRIVE EAST.
WHEREAS, Surjit & Chandra S. Kanwal have requested a variance to allow
construction of a room addition on an extreme slope at 4401 Palos Verdes Drive
East; and
WHEREAS, after notice issued pursuant to the provisions of the Rancho
Palos Verdes Development Code, a public hearing was held on Wednesday,
January 13, 1987 at which time all interested parties were given an opportunity
to be heard and present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are no exceptional or extraordinary circumstances
or conditions applicable to the property involved which do not apply generally
to other property in the same zoning district, as many of the lots in the area
contain similar extreme slopes which limit their development.
Section 2: That said Variance is not necessary for the preservation
and enjoyment of a substantial property right of the applicant, which right is
not possessed by other property owners under like conditions in the same zoning
district; in that the size, configuration and topography of the lot is similar
to other lots in the same area and older pad lots found throughout the zoning
district.
Section 3: That the granting of such a Variance will be contrary to
the objectives of the General Plan since this document requires that the City
enforces the grading ordinance with detailed controls and performance standards
to ensure both engineering standards and appropriate topographic treatment of
slopes based upon recognized site planning and landscape architectural standards.
Section 4: For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby denies Variance No. 149.
