PC RES 1987-002 RESOLUTION P.C. NO. 87 - 2 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO. 111 WHEREAS, Mr. and Mrs. Jerome Sorkin have requested a conditional use permit to allow installation of four (4) lights on a private tennis court located at 27 La Vista Verde; and WHEREAS, following public notice, issued pursuant to the provisions of the City's Development Code, a public hearing was held on December 9, 1986 at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That the site is adequate in size and shape to accommodate said use for all of the yards, setbacks, walls, fences, landscaping and other features required by the Development Code, and that a tennis court is a permitted use in an RS-2 zoning district. Section 2: That La Vista Verde provides adequate vehicular access to the site, since the dwelling unit and private tennis court will not generate excessive traffic. Section 3: That the Planning Commission does hereby declare that the final Negative Declaration has been completed in compliance with State and local guidelines and that the Commission has reviewed and considered the contents of the Initial Study in reaching its decision. The Planning Commission further finds that a lighted private tennis court in this area will not result in a significant adverse effect on adjacent properties or permitted use thereof since conditions are hereby imposed to mitigate potential impacts. Section 4: That the use is not contrary to the General Plan, since private recreational uses are encouraged and the view impacts have been mitigated. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby grants approval of Conditional Use Permit No. 111 subject to the conditions found in Exhibit "A" of this resolution. OrLo, Crperso n n —7°?//1 ob t enard Dir ctor of Environmental Services and Secretary to the Commission EXHIBIT "A" CONDITIONAL USE PERMIT NO. 111 IS HEREBY APPROVED SUBJECT TO THE FOLLOWING CONDITIONS: 1. The tennis court shall be used no earlier than 7:00 a.m. nor later than 9:00 p.m. on any day. 2. That the lights be turned off when the court is not in use. 3. Light fixtures shall not exceed 1000 watts per bulb nor have more than one bulb per fixture and shall be shielded to prevent light spillover to other properties. 4. That the lighting, housing, shields and pole shall be painted with flat black paint. 5. That any change in number, type or intensity of light fixtures shall be approved by the Director of Environmental Services and if determined to be significant by the Director of Environmental Services a review of the proposed change by the Planning Commission will be required. 6. That the applicant submit a landscape plan to be reviewed and approved by the Director of Environmental Services which will assist in attenuating any light spill over from the courts. 7. That there be no commercial use of the tennis court. Tournaments for philanthropies, not classified as commercial use, shall require the issuance of a Special Use Permit. 8. At the end of one year, these conditions will be reviewed by the Director of Environmental Services and may be changed as found appropriate with Planning Commission concurrence. 9. That the court be treated with a non-glare surface. 10. That the applicant agrees, in writing, within thirty (30) days of the adoption of this resolution to the conditions contained herein.
