PC RES 1986-036 RESOLUTION P.C. NO 86 - 36 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 142 WHEREAS, Mr. and Mrs. Andre Johnson have requested a variance for the existing deck that encroaches into the minimum required rear setback of 15 feet by ten (10) feet, six (6) inches and has footings in an extreme slope at 5840 Scotwood; and WHEREAS, after notice issued pursuant to the provision of the Rancho Palos Verdes Development Code, a public hearing was held on November 25, 1986, at which time all interested parties were given an opportunity to be heard and present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property involved which do not apply generally to other property in the same zoning district; in that the subject lot is smaller in total size and shallow in depth as compared to minimum standards established for the zone. Section 2: That said variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, which right is possessed by other property owners under like conditions in the same zoning district; in that the size configuration and topography of the lot limits the areas where level, outdoor space can be established. Section 3: That the granting of the variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area the property is located since the deck and gazebo are not visible from surrounding residential developments. Section 4: That the granting of such a variance will not be contrary to the objectives of the general plan. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 142. APPROVED and ADOPTED December 9, 1986. oan S.
