A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 144
WHEREAS, Mr. Malakoff has requested a variance to change the designated
property line for a flag lot at 30017 Via Rivera, as defined by the City
Development Code; and
WHEREAS, after notice pursuant to the City's Development Code a public
hearing was held on November 12, 1986, at which time all interested parties
were given an opportunity to be heard and present evidence.
NOW, THERFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional and extraordinary circumstances
or conditions applicable to the property involved, wherein the developed parcel
is inconsistent with the Code definition for setbacks for flag lots and as
this parcel was developed prior to City incorporation.
Section 2: That such variance is necessary for the preservation
and enjoyment of a substantial property right of the applicant, to utilize
the yard areas of the residences, as the house was originally sited; the east
and west property line as the side property lines, south property line as the
front property line and north property line as rear property line, which right
is possessed by other owners under like conditions in the same zoning district
as originally developed.
Section 3: That granting of the variance will not be materially
detrimental to the public welfare or injurious to property and improvements
in the area in which the property is located as the structure is designed to
lessen its impact on surrounding properties.
Section 4: That the granting of such a variance will not be contrary
to the objectives of the General Plan in that it is encouraging reasonable
development of the property without impairing the views of neighboring properties
or creating any safety hazards.
Section 5: For the foregoing reasons, the Planning Commission of
the City of Rancho Palos Verdes hereby approves Variance No. 144.
APPROVED and ADOPTED November 12, 1986.
