PC RES 1986-029 RESOLUTION P.C. NO. 86- 29 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES GRANTING A NEGATIVE DECLARATION AND CONDITIONAL USE PERMIT NO. 113 FOR THE CONSTRUCTION OF A PUBLICLY-OWNED MAINTENANCE FACILITY IN A LIMITED COMMERCIAL ZONE TO BE TEMPORARILY OCCUPIED BY THE LOS ANGELES COUNTY FIRE DEPARTMENT. WHEREAS, Miraleste Recreation and Park District, a publicly financed special assessment agency, has requested approval of a Negative Declaration for Environmental Assessment No. 497 for Conditional Use Permit No. 113 to construct a maintenance facility at 29515 Miraleste Plaza in a limited commercial (CL) district to be temporarily occupied by the Los Angeles County Fire Department. WHEREAS, after notice issued pursuant to the provisions of the City's Development Code, a hearing was held on October 28, 1986 at which time all interested parties were given an opportunity to be heard and to present evidence. NOW, THERFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That the proposed construction of a publicly-owned maintenance facility and temporary occupation by the fire department is permitted in the zone, subject to the issuance of a conditional use permit. Section 2: That the proposal will have no significant impacts on the environment, due to the implementation of the mitigation measures contained in the Final Negative Declaration for E.A. No. 497, which have been incorporated into the conditions of approval in Exhibit "A" of this resolution. Section 3: That the proposed project is not contrary with the intent of the General Plan. Section 4: That, given the project's location, design, and the uses adjacent to the subject property, which include retail commercial, an existing fire station and recreational open space, granting the conditional use permit will not adversely affect the peace, health, safety or general welfare of the area, nor will it be materially detrimental to property values, jeopardize, endanger or otherwise constitute a menace to the public health, safety or general welfare of persons or properties in the surrounding area. Section 5: That the subject property being approximately five thousand square feet, is adequate in size and shape to accommodate the proposed uses and other development features which might be prescribed in this Resolution. Section 6: That the subject property, which fronts Miraleste Plaza, a fully developed street with curbs, gutters, street lights and street trees, is adequately served by public and private facilities and by a highway of sufficient width and improvements to carry the kinds and quantity of traffic the proposed use might generate. Section 7: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby grants a conditional use permit for the uses described herein, subject to the conditions of approval in Exhibit "A", which are necessary to protect the public health, safety and general welfare in the area and will make possible development of the city in an orderly and efficient manner and in conformity with the intent and purposes set for in this title. Resolution No. 86- 29 Page - 2 - EXHIBIT "A" Conditions of Approval 1 . The proposed flood lamps shall be eliminated from the bulletin board structure. Instead, the bulletin board shall be internally illuminated and theathwa P Y shall be lit with low, landscape lighting fixtures. 2. At the time the Los Angeles County Fire Department vacates the subject site, the microwave tower, temporary trailer, storage container and any other structures or fixtures associated with its occupancy shall be completely removed from the subject site. 3. The temporary sign to identify Fire Station No. 83 shall meet all applicable criteria set forth in Section 17.52.060 of the Development Code regarding signage in a limited commercial district. 4. The applicant shall use the parcel across the alley from the subject site, as i s, for parking while the Fire Department occupies the site. once the temporary buildings are removed, a minimum of two (2) parking spaces shall be designated on the site within 60 days. 5. Subject to the approval of the Director of Public Works, the applicant shall arrange to designate the alley as a fire lane and post standard warning signs at both entrances to the alley. Standard "NO PARKING signs shall be posted along the length of the alley and a special lane shall be designated for cars waiting in line at the automatic bank teller. 6. The Fire Department and its employees shall not turn on emergency sirens and other warning devices on emergency vehicles, until the vehicles have reached Palos Verdes Drive East or Via Del Plaza. 7. Theapplicant shall submit a landscape, lighting and irrigation plan for review and approval by the Director of Environmental Services. 8. The applicant shall provide a trash enclosure on the subject site that shall be enclosed on four (4) sides by a solid structure or wall , six (6) feet in height, constructed of material compatible with the main structure and screened from view from any public street. One side of the structure shall be a solid, self-latching gate adjacent to adequately paved concrete access for collection. 9. Any roof-mounted equipment not included in this application shall be subject to the review and approval of the Director of Environmental Services.
