PC RES 1986-027 RESOLUTION P.C. NO. 86-27 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 137 AND GRADING NO. 908 WHEREAS, Mr. Nick J. Bjazevich has requested approval of a Variance and Grading application to construct a new single family residence which would encroach into the required 20' front setback by 14'-6" and also into an extreme slope; and, WHEREAS, after notice pursuant to the City's Development Code, a public hearing was held on Tuesday, September 9, 1986, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional and unusual circumstances relating to the subject property in that it is substandard in lot area and lot depth for the RS-4 zone, and also has extreme slopes over 50±% of the lot area. Section 2: The variance and grading applications are necessary to preserve and allow for the enjoyment of a substantial property right of the applicant, which right is enjoyed by other property owners under like conditions in the same zoning district in that the subject property is a legal lot, and these approvals are necessary in order to allow for the designated land use of the property in a reasonable manner. Section 3: That the granting of the variance would not be detrimental to the health, safety or general welfare of the surrounding properties in that the side and rear setbacks meet or exceed code requirements, the indirect access garage will not cause blockage of the sidewalk, building mass has been reduced, and no building permits will be issued without clearance from the City Geologist. Section 4: That the granting of this variance is not contrary to the General Plan in that the intended use of property is in keeping with the General Plan land use designation. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 137 and Grading No. 908 subject to the conditions contained in Exhibit A . _ .ched hereto and made a part hereof. These applications shall expire one year from the date of their approval, unless application for building permits has been made. One, one-year extension may be granted by the Planning Commission if requested prior to expiration. 2. A 2-car, indirect access garage is required. Said garage shall have a minimum back-up/turn around of 25 feet. 3. A minimum front setback of 5'-6" is permitted for the first story of the house and for the garage; however, the second story shall have a minumum front setback of 10 feet. This additional setback may be open deck area or roof. 4. All existing improvements from 2072 Dorado Drive which encroach into the subject property shall be removed prior to issuance of building permits. 5. The house shall be internally wired for cable television. 6. All utilities serving the subject property shall be provided underground. 7. The City Geologist shall review and approve the proposed project prior to issuance of any permits. All recommendations of the City and consulting geologists shall be incorporated into the final building and grading plans. 8. The maximum allowed up-slope retaining wall height shall be 8'-9". 9. Building and grading plans, revised as per the above conditions, shall be reviewed and approved by the Director of Environmental Services prior to submittal for Building plan check. 10. All trees planted on the subject property shall be maintained so as not to interfere with the views from surrounding properties. Such views shall be defined in Section 17.02.040.C.1 and 2 of the City's Development Code. Exhibit "A" of Resolution P.C. No. 86 - 27
