A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF RANCHO PALOS VERDES DENYING
CONDITIONAL USE PERMIT NO. 98 AND ALLOWING
SUBMITTAL OF A SIMILAR APPLICATION AT ANY
TIME.
WHEREAS, Texaco, Inc. has requested approval for a self-service
gas station and convenience-mart to be located at 28821 S. Western Avenue;
and
WHEREAS, after notice issued pursuant to the provisions of the
City's Development Code, a public hearing was held on October 28, 1985 and
February 25, 1986, at which time all interested parties were given an
opportunity to be heard and present evidence.
NOW, THEREFORE THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Sect,on 1: That, as proposed, the site is not adequate in size and
shape for the intended use.
Section 2: That the self-service gas station and convenience-mart
is contrary to the objectives of the General Plan and Specific Plan No. 2.
Section 3: That the concurrent ,.sales of alcoholic beverages and
gasoline on the same premises is not in the best interest of the public health,
safety and general welfare due to the encouragement to drink and drive,
potential sales to minors and loitering.
Section 5: For the foregoing reasons, the Planning Commission of
the City of Rancho Palos Verdes hereby denies Conditional Use Permit No. 98.
Section 6: The Planning Commission will allow the submittal
of an application which is the same or substantially the same as Conditional
Use Permit No. 98 at any time.
