PC RES 1986-005RESOLUTION P.C. NO. 86 - S A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO. 104. WHEREAS, Josef Kubicek has requested a Conditional Use Permit to allow existing tennis court lighting at 418 La Vista Verde. WHEREAS, after notice pursuant to the City's Development Code, a public hearing was held on February 11, 1986, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That the site for the tennis court lights will be adequate in size and shape to accommodate said use once the lot line is adjusted as required by this approval. Section 2: That granting the Conditional Use Permit for the tennis court lights will not cause any significant adverse effect on adjacent property or the permitted use thereof because views will not be impaired and the number and intensity of the lights and the use of the court will be controlled by the conditions contained herein. Section 3: That granting this Conditional Use Permit is not contrary to the General Plan. Section 4: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves Conditional Use Permit No. 104 for tennis court lights subject to the following conditions necessary to protect the public health, safety, and general welfare: A. The tennis court shall be used no earlier than 7:00 AM and not later than 9:00 PM. B. The lights shall be turned off when the court is not in use. C. Light fixtures shall not exceed 500 watts per bulb. D. Any change in the number, type, or intensity of light fixtures or the use of the court shall be approved by the Planning Commission. E. Commercial use of the tennis court, including any type of tournament play is prohibited. F. The court shall be treated with a non -glare, earth - tone colored, surface (i.e., standard brown and green), within 60 days of Planning Commission approval. G. A fire break, as required by the Fire Department shall be provided and maintained around the tennis court and changing room within 60 days of Planning Commission approval. H. Any construction debris dumped in the canyon shall be removed within 60 days of Planning Commission approval. I. Periodically, the Director of Environmental Services shall review compliance with these conditions and report any violations or complaints to the Planning Commission. Based on this report, the Commission may reconsider or modify its approval if warranted. J. The existing carport shall be replaced with two enclosed garage parking spaces within 12 months of Planning Commission approval. Such construction is subject to City permit requirements. K. Three "NO SMOKING" signs, 1 X 3 feet in size, shall be posted in conspicuous places around the tennis court and storage room within 60 days of Planning Commission approval. L. The applicant shall agree in writing, within 30 days, to this resolution and conditions, and, in partial consideration for the issuance of such, shall record such conditions as ranning with the land.
