PC RES 1985-028 RESOLUTION P.C. NO. 85-28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 130, TO PERMIT A PROPOSED AWNING TO ENCROACH TWO (2) FEET BEYOND THE ALLOWED PROJECTION FOR ROOF OVERHANGS/EAVES. WHEREAS, Collins Property, Inc. has applied for Variance No. 130 to allow an additional 2 foot roof overhang at 29019 South Western Avenue, and; WHEREAS, a public hearing was held on Tuesday, October 22, 1985 at which time all interested parties were given an opportunity to be heard and present evidence; NOW, THEREFORE, the Planning Commission of the City of Rancho Palos Verdes does hereby find, determine and resolve as follows: Section 1 : That there are exceptional or extraordinary circumstances or conditions applicable to the property involved, or to the intended use of the property, which do not apply generally to other property in the same zoning district; in that the subject lot, located at 29019 South Western Avenue, does not meet the minimum dimension requirements for the CG zone, thereby creating a hardship in allowing for larger setbacks which in turn would allow for greater architectural design treatments. Section 2: That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, which right is possessed by other property owners under like conditions in the same zoning district; in that the use of canvas awnings is becoming wide spread for the purpose of brightening a building facade and attracting business. Section 3: That the granting of the variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located; in that the affected frontage is facing a major commercial arterial highway. Section 4: That the granting of such a variance will not be contrary to the objectives of the General Plan; in that the proposed awnings would be reviewed at the time that the future Specific Plan for this location is reviewed. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 130 subject to the conditions contained in Exhibit 'A' , attached hereto. Hightower Director of Environmental ervices and Secretary to the Commission EXHIBIT 'A' , RESOLUTION P.C. NO. 85- 28 Variance No. 130 is approved subject to the following conditions: 1 . This variance is granted for one year and shall be su j bect to review by the Planning Commission at such time as the Specific Plan for this section of Western Avenue undergoes reviews so as to determine compatibility with said Specific Plan and if the Variance shall be extended. 2. The proposed awning fronting Western Avenue shall have a minimum 12 foot setback from the front property line; and maintain a minimum eight (8) feet of vertical clearance measured from finished grade to the bottom of said awning. 3. All appropriate permits shall be obtained from the Building and Safety Division prior to installation of the proposed awning. 4. The subject awning of this variance shall not contain any signage of any type or form.
