PC RES 1985-019 RESOLUTION P.C. NO. 85- 19 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES, APPROVING VARIANCE NO. 120 ALLOWING CONSTRUCTION OF CERTAIN RENOVATIONS WITHIN THE REQUIRED STREETSIDE SETBACK AT 5762 RAVENSPUR DRIVE, RANCHO PALOS VERDES. WHEREAS, Ted and Virginia Gardner have requested a Variance to construct new planters, a stepped wall, a canopy and screening, and balcony enclosures within the required streetside setback of 15 feet; and WHEREAS, after notice was issued pursuant to provisions of the Rancho Palos Verdes Development Code, a public hearing was held on Tuesday, June 25 and July 23, 1985, at which time all interested parties were given the opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property involved, or to the use of the property, which do not apply generally to other property in the same zoning P y� district; in that no other apartment building in the City has such a minimal streetside setback along a major arterial. Section 2: That this variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, which right is possessed byother property owners under like conditions in the same zoning inowners of property in the same zoning district enjoy district; that other P P larger streetside setbacks along major arterials. Section 3: That the granting of this variance would ,not be materially detrimental to public the welfare or injurious to property and improvements in the area in which the property is located; in that the proposed encroachments would not interefere with pedestrian traffic, and would improve the appearance and use of the subject building. Section 4: That the granting of this variance would not be contrary to the objectives of the general plan. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 120 subject to the conditions contained in Exhibit "A", attached hereto. No. 85-19 EXHIBIT "A" Variance No. 120 is approved subject to the following conditions: 1. The applicant shall submit to the City for review and approval, a deed restriction prohibiting use of the enclosed balconies as additional living area. This deed shall give the City the ability to cause such a use to cease and the balcony restored to its intended use. A recorded copy of the deed restriction shall be provided to the Director of Environmental Services prior to the issuance of any permits. 2. None of the rennovation work subject to this variance shall encroach more than 13 feet into the required 15 foot setback. 3. This variance shall expire one (1) year frau the date of approval if building permits have not been issued. The Planning Ccmmission may grant additional time extensions prior to expiration. #601.CP-EX.A
