NO. 85-12 1 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES RECOMMENDING APPROVAL OF COASTAL PERMIT NO. 15 AND TENTATIVE TRACT MAP 43725 WHEREAS, Kenneth, and Alice Wong have requested approval of Coastal Permit No. 15 and Tentative Tract Map 43725 for the purposes of reverting Tract 32977 to acreage in compliance with the conditions of approval for CUP 27, Tract 32977; and WHEREAS, after notice issued pursuant to the City's Development Code, public hearings were held on May 28 and June 11, 1985, at which time all interested parties were given an opportunity to be heard and present evidence. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That the proposed reversion to a 1.55 acre lot is not contrary to the Coaital Specific Plan because said lot would be within the desig- nated land use density for that location. Section 2: That the proposed reversion to acreage does not involve any form of development, but will leave the subject property in its present undeveloped state. Section 3: That given the nature of Tentative Tract Map 43725, there would be no significant adverse effect on the peace, health, safety or general welfare of the area, nor will it be materially detrimental to property values, jeopardize, endanger or otherwise constitute a menace- to the public health, safety and welfare of persons in the surrounding area. Section 4: That there will be no significant adverse environmental impacts associated with this reversion to acreage as it has been deemed Categorically Exempt pursuant to the California Environmental Quality Act. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby recommends approval of Coastal Permit No. 15 and Tentative Tract Map 43725 to the City Council, subject to the condition contained in Exhibit W, which is necessary to protect the public health, safety and general welfare in the area. NO. 85- 12 EXHIBIT 'A' Conditions of approval for Tentative Tract Map 43725: (1) This approval expires twenty-four (24) months from the date of approval of this tract map by the City Council of the City of Rancho Palos Verdes. Should the applicant not obtain final approval within this time period, the City shall proceed with the necessary processing to record this map, and charge the applicant accordingly. (2) Dedicate vehicular access rights along Palos Verdes Drive South frontage to the City of Rancho Palos Verdes on the Final Map. (3) If signatures of record title interests appear on the Final Map, submit a preliminary guarantee. A final guarantee will be required at the time of filing of the Final Map with the County Recorder. If said signatures do not appear on the Final Map, a preliminary title report/guarantee is needed that covers the area showing all fee owners and interest holders. The account -for -this preliminary title report/guarantee should remain open until the Final Map is filed with the County Recorder. (4) Prior to recordation of the Final Map, the developer shall comply with Section 66493-C (relative to special assessments) df the State Subdivision Map Act. (5) Within thirty (30) days the developer shall submit, in writing, a statement that he has read and understands all conditions of approval. (6) The City's filing fee for a Final Map shall be paid within six (6) months of approval of the tentative map. (7) The developer shall supply the City with one brownline and one print of the recorded map.
