PC RES 1985-004RESOLUTION P.C. NO. 85-4 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 114 WHEREAS, Mr. and Mrs. Charles Leedy have requested a Variance for the construction of a garage addition which would encroach into the minimum required front setback of 20 feet by 10.25 feet; and WHEREAS, after notice issued pursuant to the provision of the Rancho Palos Verdes Development Code, a public hearing was held on January 29, 1985, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are no exceptional or extraordinary circum -- stances or conditions applicable to the property involved which do not apply generally to other property in the same zoning district; in that neighboring properties and others in the RS -5 zone are, and have been subject to the same front setback requirements for new construction and there are no unique con- ditions on this property. Section 2: That such Variance is not necessary for the preser- vation and enjoyment of a substantial property right of the applicant, which right is not possessed by other property owners under like conditions in the same zoning district; in that other owners of single family residences built prior to December 1975 have had to comply to the same 20 foot front setback requirements, if such new construction took place after that effective date. Three car garages are a matter of individual preference, not code requirements. Section 3: That granting of the Variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located; in that the proposed encroachment would not impact any views, change circulation or drainage patterns, etc., in such a way as to be injurious to the neighborhood. Section 4: That the granting of such a Variance would not be contrary to the objectives of the General Plan. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby denies Variance No. 114. APPROVED and ADOPTED this 29th day of January, 1985.
