A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES APPROVING VARIANCE NO. 105 AT
30825 MARNE DRIVE
WHEREAS, Variance No. 105 has been filed which would allow a combination
wall/handrail over forty-two inches (42") in height within the required front
setback; and
WHEREAS, after notice pursuant to the City's Development Code, public
hearings were held on June 12 and October 23, 1984 at which time all interested
parties were given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: A determination must be made that there are exceptional or
extraordinary circumstances or conditions that exist relative to this property
which do not apply generally to other properties in the same zoning district;
there is an exceptionally severe retaining situation at this site which re-
quires mitigating meausres.
Section 2: A determination must be made that a Variance is necessary
for the "preservation and enjoyment of a substantial property right of the
applicant which right is possessed by others under like conditions"; given the
applicant's requirement to maintain adequate space for handicapped access to the
front of the house, this condition is justified.
Section 3: A determination must be made that granting a Variance would
not result in adverse effects to the public welfare or the surrounding development
patterns; through the mitigating measures associated with this Variance, the severity
of an existing dangerous situation would be substantially decreased.
Section 4: A review of the objectives and policies of the General Plan
must show that the Variance request is in compliance with the General Plan; as
stated in "C" above, the mitigating measures associated with this Variance will
increase the public safety and welfare, hence being in concurrence with the
intent of the General Plan.
Section 5: For the forgoing reasons, the Planning Commission of the City
of Rancho Palos Verdes hereby approves Variance No. 105.
