PC RES 1984-015 RESOLUTION P.C. NO. 84-15 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 102 WHEREAS, Variance No. 102 has been filed which requests that the wall and wrought iron gates which exceed forty-two inches (42") in the front setback and public right-of-way be allowed to remain; and WHEREAS, after notice pursuant to the City's Development Code, a public hearing was held on April 24, 1984 at which time all interested parties were given the opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF.THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: Granting this Variance is unnecessary because there are no exceptional or extraordinary circumstances or conditions that exist relative to this property which do not apply generally to other properties in the same zoning district which would necessitate a wall, arch, pilasters, and/or gates which exceed forty-two inches (42") to encroach into the front setback and public right-of-way. Section 2: Granting this Variance is unnecesary for the "preservation and enjoyment of a substantial property right of the applicant which right is possessed by others under like conditions" as the existing wall, (including arch, pilasters, and wrought iron gates) which exceed forty-two inches (42") in height are deemed unnecessary at present heights to adequately enclose the applicant's property. Section 3: Granting this Variance would resultin adverse effects to the public welfare based on the premise that allowing the wall, arch, or pilasters to exceed the maximum forty-two inch (42") height limit (pursuant to the_ Development Code) in such close proximity to the roadway and driveway would create a safety hazard based on visibility criteria. Section 4: This Variance is not in compliance with the objectives and policies of the General Plan as the wall (arch, pilasters, and wrought iron gates) adversely affects public safety and welfare at it's current height and placement. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby denies Variance No. 102, and requires that the wall/ gates/pilasters/arch be removed.
