PC RES 1984-014 411110 41/II/ RESOLUTION P.C. NO. 84- 14 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 103 WHEREAS, Kevin and Christy Figlewicz have requested a Variance to allow a nonconforming retaining wall with pilasters to remain and install handrailing; and WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held on May 8, 1984, at which time all interested parties were given an opportunity to be heard and present evidence. NOW , THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property involved, or to the intended use of the property, which apply generally to other property in the same zoning district; in that the subject nonconforming wall including pilasters were existing on the subject property prior to ownership by the applicants. Section 2: That such variance is necessary for preservation and enjoyment of a substantial property right of the applicants, which right is possessed by other property owners under like conditions in the same zoning district; in that the pilasters and proposed handrail will conform to building code and eliminate potential safety hazards. Section 3: That the granting of the variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located; in that the wall, pilasters and handrail would not pose any visibility or safety problems to vehicular and pedestrian traffic. Section 4: That the granting of such variance will not be contrary to the objectives of the General Plan. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 103. APPROVED and ADOPTED this 8th day of May, 1984.
