RESOLUTION P.C. NO. 84-13
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 101
WHEREAS, Robin Wonder has requested a Variance for the construction
of a wood deck which would exceed the 12 foot maximum allowed height by
approximately six (6) feet; and
WHEREAS, after notice issued pursuant to the provision of the Rancho
Palos Verdes Development Code, a public hearing was held on April 24, 1984, at
which time all interested parties were given an opportunity to be heard and
present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary circumstances
or conditions applicable to the property involved, or to the intended use of the
property, which apply generally to other property in the same zoning district; in
that the rear yard in the location of the proposed deck slopes in two (2) directions.
Section 2: That such Variance is necessary for the preservation and
enjoyment of a substantial property right of the applicant, which right is possessed
by other owners under like conditions in the same zoning district; in that pool
decks are commonly found in similar situations where there is a down slope from the
pool, providing a flat, safe area immediately surrounding the pool.
Section 3: That the granting of the Variance will not be materially
detrimental to the public welfare or injurious to property and improvements in
the are in which the property is located; in that the proposed deck will be located
in the rear yard of the subject property having no impact on the general public and
will blend with the existing structure.
Section 4: That the granting of such a Variance will not be contrary to the
objectives of the General Plan; ii that the deck will provide usable, private,
recreational open space for the subject property.
Section 5: For the foregoing reasons, the Planning Commission of the City
of Rancho Palos Verdes hereby approves Variance No. 101.
