PC RES 1984-011 411 1110 RESOLUTION P.C. NO. 84- 11 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 99 WHEREAS, Frank and Kathleen Agostino have requested a Variance for the encroachment of a garage into the minimum required 20 foot front setback six (6) feet; and WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held on April 24, 1984, at which time all interested parties were given an opportunity to be heard and prevent evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property involved which do not apply generally to other property in the same zoning district; in that the subject property is substantially smaller than the minimum required lot area for the RS-4 zoning district (5,600 square feet v 10,000 square feet) , making Code compliance extremely difficult. Section 2: That such Variance is necessary for preservation and enjoyment of a substantial property right of the applicant, which right is possessed by other property owners under like conditions in the same zoning district; in that small lot size makes Code compliance diffuclt, while striving to increase a very small living area. Section 3: That granting the Variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located; in that the proposed two-car garage would improve existing parking conditions. Section 4: That the granting of such a Variance will not be contrary to the objectives of the General Plan; in that parking and living conditions will be improved by this Variance. Section 5: For the foregoing reasons, the Plan Commission of the City of Rancho Palos Verdes hereby approves Variance No. 99 on the conditiors that an automatic garage door opener is installed and the existing concrete driveway is removed upon completion of the proposed garage and driveway.
