PC RES 1984-003 RESOLUTION P.C. NO. 84-3 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 95 WHEREAS, John and Sandra Murdock have requested a Variance for the construction of a garage which would encroach into the minimum required front setback of 20 feet by five feet, nine inches; and WHEREAS, after notice issued pursuant to the provision of the Rancho Palos Verdes Development Code, a public hearing was held on December 13, 1983 and February 14, 1984 at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are no exceptional or extraordinary circum- stances or conditions applicable to the property involved which do not apply generally to other property in the same zoning district; in that neighboring properties are, and have been subject to the same front setback requirements for new construction and there are no unique conditions on this property. Section 2: That such Variance is not necessary for the preservation and enjoyment of a substantial property right of the applicant, which right is not possessed by other property owners under like conditions in the same zoning district; in that other owners of single family residences built prior to December 1975 have had to comply to the same 20 foot front setback requirements, if such new construction took place after that effective date. Section 3: That granting of the Variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located; in that the proposed encroachment would not impact any views, change circulation or drainage patterns, etc. , in such a way as to be injurious to the neighborhood. Section 4: That the granting of such a Variance will be contrary to the objectives of the General Plan; in that single family residential develop- ment standards for minimum front setbacks will not be met. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby denies Variance No. 95. APPROVED and ADOPTED this 14th day of February, 1984.
