PC RES 1984-001RESOLUTION. P.C. NO. 84-1 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 94 I - WHEREAS, Charles and Helen Johnston have requested a Variance for the construction of a six (6) foot wall within the 20 foot front setback area; and WHEREAS, after notice issued pursuant to the provision of the Rancho Palos Verdes Development Code, a public hearing was held on January 10, 1984, at which time all interested parties were given an opportunity to be heard and present evidence. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property involved which do not apply generally to other property in the same zoing district; in that the subject property is of a peculiar shape and topography, such that a 20 foot front setback encompasses much of the usable yard area, which severly limits the use of said yard area. Section 2: That such variance is necessary for preservation and enjoy- ment of a substantial property right of the applicant, which right is possessed by other property owners under like conditions in the same zoning district; in that privacy and security for yard and pool areas are enjoyed by the majority of residences within the zoning district. Section 3: That granting of the Variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located; in that the proposed wall will not add to visibility obstruction at that portion of Via Siena. Section 4: That the granting of such a Variance will hot be -contrary to the objectives of the General Plan; in that this Variance will allow for the greater use of private, individual recreation area, thereby helping to reduce demand for public recreation facilities. Section 5: That all vegetation within the required 20 foot front setback area be kept trimmed to the maximum height of 42 inches. Section 6: For the foregoing reasons and conditions, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 94. APPROVED and ADOPTED this 10th day of January, 1984.
