PC RES 1982-026 ill 110 RESOLUTION P.C. NO. 82-26 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 81 WHEREAS, Variance No. 81 has been filed which requests approval to divide an existing 77,362.56 square foot parcel into one standard and one substandard lot: 47,916.00 square feet and 29,010.96 square feet respectively (Tentative Parcel Map No. 15258) ; and WHEREAS, the vacant lot is located at the northeast corner of Palos Verdes Drive South and Forrestal Drive, which is in a RS-1 zoning district; and WHEREAS, a Negative Declaration was granted in compliance with City and State guidelines and the Commission has reviewed and considered the contents of the Initial Study (Environmental Assessment No. 430) in reaching its decision; and WHEREAS, proper notice was made pursuant to the provisions of the City's Development Code and hearing was held on September 28, 1982, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are not exceptional or extraordinary circumstances applicable to this property, or to the intended use of the property, which do not apply generally to other properties in the same zoning district since other sites in the same zoning district experiencing similar physical constraints are subject to minimum lot area requirements. Section 2: That the variance is not necessary for the preservation and enjoyment of a substantial property right of the applicant, which is possessed by other property owners under like conditions in the same zoning district, since properties experiencing similar conditions are subject to and must abide by the minimum required development standards. Section 3: That the granting of the variance would not be materially detrimental to the public welfare or injurious to properties and improvements in the surrounding area, since there is no substantial evidence that such an effect would occur. Section 4: That the granting of the variance will be contrary to the objectives of the General Plan since, due to its designated environmental constraints (extreme/high slopes) the site is classified as low density. Section 5:. For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby denies Variance No. 81. APPROVED and ADOPTED this 28th day of September 1982. v • Douglas M.
