PC RES 1982-021RESOLUTION P.C. NO. 82-21 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 83 WHEREAS, Robert Chapman has requested a variance for_the2construction of a room addition encroaching into the front yard setback on the property lo- cated at 30757 Rue Valois; and WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held on August 24, 1982, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property involved, or to the intended use of the property, which do not apply generally to other property in the same zoning dis- trict because the way the house is situated on -the lot the variance is necessary in order to provide for reasonable development of the property with the addition and for the driveway to provide reasonable access to the existing garage. Section 2: That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, which right is possessed by other property owners under like conditions in the same zoning district since there are others in the neighborhood with similar circumstances. Section 3: That the granting of the variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located since it will be similar to those in the area. Section 4: That the granting of such a variance will not be contrary to the objectives of the General Plan since it is encouraging reasonable devel- opment of the property without encroaching into the views of neighboring resi- dences.. _ - Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 83 subject to the con- ditions in the attached Exhibit "A".
