PC RES 1982-019RESOLUTION P.C. NO. 82-19 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 82 WHEREAS, Christopher Bisgaard has requested a variance for the construction of a single family residence with a maximum height of forty-two (42') feet, six (611) inches on the property located at 6386 Chartres Drive; and WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held July 27, 1982 and August 10, 1982, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORK, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are no exceptional•or extraordinary circumstances or conditions applicable to the property involved which do not apply generally to other property in the same zoning district because neighboring properties are subject to the same lot conditions. Section 2: That such variance is not necessary for the preservation and enjoyment of a substantial property right of the applicant, which right is possessed by other property owners under like conditions in the same zoning district, because neighboring properties subjected to the same lot conditions have been developed without exceeding the Municipal Code's maximum height re- quirement. Section 3: That the granting of the variance may be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located. Section 4: That the granting of such a variancewill be contrary to the objectives of the General Plan since the proposed project is contrary to the General Plan's policies regarding excessive amounts of grading. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby denies Variance No. 82. APPROVED and ADOPTED this 24th day of August 2 1982. Douglas M.
