PC RES 1982-006• A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 77 WHEREAS, Mr. and Mrs. Schmid have requested a variance to allow a second story addition which encroaches up to twelve (12) feet into the required twenty (20) foot front setback at 2855 Colt Road, Rancho Palos Verdes; and WHEREAS, after notice pursuant to the City's Development Code, a public hearing was held on March 9, 1982, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property involved which do not apply generally to other property in the same zoning district since the natural terrain of the lot does not provide suitable building area for a single story addition and the existing primary structure encroaches into the front yard setback. Section 2: That this variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, which right is possessed by other property owners under like conditions in the same zoning district since other property owners in the area enjoy the same encroachment. Section 3: That granting this variance will not be materially detrimental to the public welfare of injurious to property and improvements in the area in which the property is located since the addition will not significantly obstruct primary views from neighboring properties, or pose a visibility or traffic safety problem. Section 4: That granting this variance is not contrary to the objectives of the General Plan. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 77. APPROVED and ADOPTED this 9th day of March , 1982. /Sharon W.
