PC RES 1981-0560 RESOLUTION P.C. NO. 81-56 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 72 WHEREAS, Mr. and Mrs. Nickel have requested a variance to allow a garage addition to encroach sixteen (16) feet into the required twenty (20) foot front setback at 77 Rockinghorse Road, Rancho Palos Verdes; and WHEREAS, after notice pursuant to the City's Development Code, a public hearing was held on October 27, 1981, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That the unusually small buildable area of the lot creates an exceptional circumstance that is applicable to this property, or to the intended use on the property, which does not apply generally to other property in the same zoning district. Section 2: That this variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, which right is possessed by other property owners under like conditions in the same zoning district since other property owners abutting private streets in the area enjoy the same encroachment. Section 3: That granting this variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located since the garage will be cut into the slope and will not obstruct the visibility along Rockinghorse Road. Section 4: That granting this variance is not contrary to the objectives of the General Plan. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 71. APPROVED and ADOPTED this 27th'day-of October, 1981.
