PC RES 1981-049L RESOLUTION P.C. NO. 81- 49 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING CONDITIONAL USE PERMIT NO. 66 AND RECOM- MENDING DENIAL OF TENTATIVE TRACT NO. 37962 WHEREAS, Palos Verdes Properties, has requested a Conditional Use Permit and Tentative Tract Map to allow sixty-four (64) single family lots and common open space on a one hundred (100) acre parcel, located north of Barkentine Road, which is zoned Residential Single Family (RS -1) and Open Space Hazard (OH); and WHEREAS, after notice issued pursuant to the provisions of the City's Development Code, public hearings were held on June 9, 1981 and June 23, 1981, at which time all interested parties were given an opportunity to be heard and to present evidence. WHEREAS, the Subdivision Map Act states that no local agency shall approve a tentative map if it makes any of the findings listed in Section 66474 of the Government Code. NOW, THEREFORE THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That the proposed Residential Planned Development (RPD) is permitted in single family districts, subject to the subject to the issuance of a Tentative Tract Map and Conditional Use Permit. Section 2: That the original proposed project is not consistent with the City's General Plan and development code for the following reasons: A. Substaintial amount of grading is proposed in the Open Space Hazard Zone. B. No consideration has been given to the project's natural features, in as much as two of the canyons are proposed to be graded and -developed upon. C. Grading is proposed in a major canyon (Barkentine canyon) which the City's General Plan identifies as a natural water course to be pre- served. Section 3: That the design of the subdivision is likely to cause serious public health problems, in as much as the emergency access road is proposed across an Active Landslide area, and a potential risk may exist during and after grading due to the geologic factors. Section 4: The applicant has not demonstrated that the sitb is physically suitable for the type of development proposed due to geologic factors Section 5: That if the project were approved there would exist a potential adverse effect to surrounding properties due to geologic factors. Section 6: That the Planning Commission does hereby declare that Final Enviromental Impact Report No. 15 has been completed in compliance with state and local enviromental guidelines and that the Commission has reviewed and considered it's contents in reaching it's decision. Section 7: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby denies Conditional Use Permit No. 66 and recommends denial of Tentative Tract No. 37962.
