PC RES 1981-048RESOLUTION P.C. NO. 81- 48 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES GRANTING VARIANCE NO. 68 FOR A PARKING STRUCTURE TO TRANSEND PROPERTY LINES ON PARCELS 3 THROUGH 5 ON TENTATIVE PARCEL MAP NO. 14369 WHEREAS, S. P. Devco, Inc., has requested a variance to allow for the construction of a parking structure which will extend from parcel 3 to parcel 5 on Tentative Parcel Map No. 14369; and WHEREAS, after proper notice was made pursuant to the City's Development Code, and public hearings were held on May 26, 1981 and June 23, 1981, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: A. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved, or the the intended use of the property, which do not apply generally to other property in the same zoning district since the site constraints preclude adding additional parking on proposed parcel 3 and these same site constraints make the possibility of providing sideyard setbacks for the parking facility unfeasible due to the disruption it would cause to traffic circulation. B. That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, which right is possessed by other property owners under like conditions in the same zoning district since a reciprocal parking agreement covers the entire development and will be a recorded document attached to any transfer of property; that proper circulation be maintained by eliminating the required sideyard setbacks for the parking structure. C. That the granting of the variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located because of the development patterns within the area, the- structure orientation to the hillside, and the restricted use of the site. D. That the granting of such a variance will not be contrary to the objectives of the General Plan. APPROVED and ADOPTED this 23rd day of June , 1981 Sharon W.
