NO. 81-47 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING TENTATIVE PARCEL MAP NO. 14369 WHEREAS, Tentative Parcel Map No. 14369 has been filed which would allow for the division of a seventeen (17)+ acre parcel into five parcels, each greater than the minimum required in a commercial professial zone; and WHEREAS, proper notice was made pursuant to provisions of the Development Code and public hearings were held on May 26, 1981 and June 23, 1981, at which time all interested parties were given an opportunity to be heard and present evidence; and WHEREAS, Tentative Parcel Map No. 14369 is located on the north side of Silver Spur Road at Crossfield which is a commercial professional zone district. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That the site is physically suitable to accomodate five (5) lots in terms of design and that said division will not result in significant environ- mental impact, based on compliance with the City's Development Code and General Plan. Section 2: That the creation of five (5) lots for commercial purposes will not be materially detramental to property values, jeopardize, endanger, or other- wise constitute a menace to the public health, safety, or general welfare of persons or properties in the surrounding area, nor will it adversely affect the peace, health, safety or general welfare in the area since conditions of approval require on and off site improvements. Section 3: That the Planning Commission does hereby declare that this project is exempt from CEQA pursuant to section 66426c of the Subdivision Map Act; and, Section 4: That Tentative Parcel Map No. 14369 is not contrary to the General Plan, based on the approppriate lot size and parking requirements which were established for this site. Section 5: The discharge of sewage from the land divison into the public sewer system will not violate the requirements of the California Regional Water Quality Control Board pursuant to Division 7 (commencing with Section 13000) of the Water Code. Section 6: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby grants approval to Variance No. 68 and approve Tentative Parcel Map No. 14369 subject to the attached conditions marked Exhibit "A", which are necessary to protect the public health, safety and general welfare in the area. This approval expires twelve (12) months from the date of approval of this request. 2. A preliminary soil report is required. The report, based upon adequate test borings or excavations, shall describe any soil or geologic condition(s) which, if not corrected, might lead to structural damage or slope failure, and shall recommend action likely to prevent possible structural damage or slope failure. A soil expansion index test is required and shall be done in accordance with -the pro- cedures of UBC Standard No. 29-2. 3. Portions of the property are subject to sheet overflow and high velocity scouring action. 4. Drainage plans and necessary support documents to comply with -the following re- quirements must be approved prior to filing of A'f.inal map: a. Provide drainage facilities to the satisfaction of the City Engineer. b. Provide for the proper distribution of drainage. c. Eliminate the sheet overflow and ponding or elevate the floors of the buildings with no openings in the foundation walls to at least 12 inches above the finished pad grade. d. Provide drainage facilities to protect the lots from high velocity scouring action. e. Provide for contributory drainage from adjoining properties. 5. The final map must be approved by the Engineering Geology Section to assure that all geologic factors have been properly evaluated. 6. All geologic hazards associated with this proposed development must be eliminated or delineate a restricted use area approved by the consultant geologist to the satisfaction of the Engineering Geology Section and dedicate to the City the right to prohibit the erection of buildings or other structures within the restricted use areas. 7. The subdivider is advised that approval of this division of land is contigent upon the installation and use of a sewer system. 8. The water mains shall be of sufficient -size to accommodate the total domestic and fire flows required for the land division. Domestic flows required are to be deter- mined by the City Engineer. Fire flows required are to be determined by the Fire Chief. 9. At the time the final land division map is submitted for checking, plans and speci- fications for the water system facilities shall be sunmitted to the City Engineer for checking and approval, and shall comply with -the City Engineer's standards. Approval for filing of this land division is contingent upon approval of plans and specifications mentioned above. If the water system facilities are not installed prior to the filing of this land division, the subdivider must also submit a Labor and Materials Bond in addition to an Agreement and Faithful Performance Bond in the amount estimated by the City Engineer guaranteeing the installation of the water system. 10. There shall also be filed with this Division a statement from the water purveyor indicating that the propsed water mains and any other required facilities will be operated by the purveyor and that under normal operating conditions the system will meet the requirements for the land division. 11. Easements are tentatively required, subject to review by the City Engineer to determine the final locations and requirements. RESOLUTION P.C. NO. 81-47 1111 III/ Exhibit "A" Page 2 of 2 12. The applicant shall provide public improvements to Silver Spur Road to the satisifaction of the Director of Public Works in Rancho Palos Verdes and the City of Rolling Hills Estates and shall include the recommendations of the Traffic Study prepared by ASL Consulting Engineers on August 27, 1979. 13. Dedicate vehicular access rights to the City of Rancho Palos Verdes along Silver Spur Road from Parcels 1 through 5, except for the three proposed driveway entrances. 14. Show private driveways and label them as "fire lane" on the final map. 15. A final map prepared by, or under the direction of, a registered civil engineer or licensed land surveyor must be processed by the City Engineer prior to being filed with the County Recorder. 16. Easements shall not be granted or recorded within areas proposed to be granted, dedicated, or offered for dedication for public streets or highways, access rights, building restriction rights, or other easements until after the final map is filed with the County Recorder unless such easements are subordinated to the proposed grant or dedication. If easements are granted after the date of tentative approval, a subordination must be executed by the easement holder prior to the filing of the final map. 17. Prior to submitting the final map to the City Engineer for his examination pur- suant to Section 66450 of the Government Code, obtain clearances from all affected Departments and Divisions including a clearance from the Subdivision Section of Mapping Division of the County Engineer for the following mapping items: mathematical accuracy, survey analysis, and correctness of certificates, signatures, etc. 18. If signatures of record title interests appear on the final map, submit a preliminary guarantee. A final guarantee will be required at the time of filing of the final map with the County Recorder. 19. The City's final map fee shall be paid to the City within six (6) months of approval. 20. Prior to approval of the final map, two (2) copies of Construction, Operation and Reciprocal Easement Agreement shall be submitted to the Director of Planning for City Attorney approval. 21. All created and natural slopes greater than 3:1 shall be (labeled) (noted) on final map as restricted use area. 22. All drainage swales shall have the cement colored to earth tones, as approved by the Director of Planning. 23. All areas outside of the approved building footprint and parking area for lot 5 shall be labeled as restricted use. 24. The applicant shall comply with all conditions of Conditional Use Permit No. 66 as stated in Resolution 81-32 of the Planning Commission of the City of Rancho Palos Verdes. 25. That a note be placed on the final map to the satisfaction of the Director of Planning that a Conditional Use Permit has been issued on this project. RESOLUTION P.C. NO. 81-47
