NO. 81- 44 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES AP- PROVING CONDITIONAL USE PERMIT NO. 75 WHEREAS, Mr. and Mrs. Robert Hansen have requested a conditional use permit to allow installation of eight (8) lights on a private tennis court lo- cated at 4140 Lorraine Road; and WHEREAS, following public notice, issued pursuant to the provisions of the City's Development Code, a public hearing was held on May 12, 1981, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That the site is adequate in size and shape to accommo- date said use and for all of the yards, setbacks, walls, fences, landscaping and other features required by the Development Code, and that a tennis court is a permitted use in an RS -3 zoning district._ Section 2: That Lorraine Road provides adequate vehicular access to the site, since the dwelling unit and private tennis court will not generate excessive traffic. Section 3: That the Planning Commission does hereby declare that the final Negative Declaration has been completed in compliance with State and local guidelines and that the Commission has reviewed and considered the contents of the Initial Study in reaching its decision. The Planning Commission further finds that a lighted private tennis court in this area will not result in a sig- nificant adverse effect on adjacent properties or permitted use thereof since conditions are hereby imposed to mitigate potential impacts. Section 4: That the use is not contrary to the General Plan, since private recreational uses are encouraged and the view impacts have been miti- gated. Section 5: For the foregoing reasons, the Planning Commission of 0 the City of Rancho Palos Verdes hereby grants approval of Conditional Use Permit No. 75 subject to the conditions found in Exhibit "A" of this resolution. APPROVED and ADOPTED this 26th day of May 31 1981. Secretary to the Commission EXHIBIT "A" CONDITIONAL USE PERMIT NO. 75 IS HEREBY APPROVED SUBJECT TO THE FOLLOWING CONDITIONS: 1. The tennis court shall be used no earlier than 7:00 a.m, and not any later than 9:00 p.m. (or dusk, whichever is later) on any day. 2. That the lights be turned off when the court is not in use. 3. Light fixtures shall not exceed 1000 watts per bulb or have more than one bulb per fixture. 4. That the light housing and shields shall be painted with flat black paint in the manner presented to the Planning Commission on May 12, 1981. 5. That any change in the number, type, or intensity of light fixtures be approved by the Director of Planning. 6. That there be no commercial use of the tennis court including any type of tournament play. 7. At the end of one year, these conditions will be reviewed by the Director of Planning and may be changed as found appropriate, in- cluding the addition of windscreens if necessary. 8. That the court be treated with a non -glare surface. 9. That the applicant agree, in writing, within thirty (30) days to this resolution and conditions. Resolution P.C. No. 81-44
