PC RES 1981-042 1110 1111 RESOLUTION P.C. NO. 81-42 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 53 WHEREAS, Variance No. 53 has been filed which requests approval to divide an existing 27,831 square foot parcel into two substandard size lots: 13,695 and 14,136 square feet (Tentative Parcel Map No. 3649) ; and WHEREAS, the vacant lot is located approximately 500 feet east of the Crest Road and Palos Verdes Drive East intersection, which is in an RS-2 zoning district; and WHEREAS, a Negative Declaration was granted in compliance with City and State guidelines and the Commission has reviewed and considered the con- tents of the Initial Study (Environmental Assessment No. 399) in reaching its decision; and WHEREAS, proper notice was made pursuant to the provisions of the City's Development Code and a public hearing was held on April 28, 1981, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances applicable to this property, or to the intended use of the property, which do not apply generally to other properties in the same zoning district because the parcel is oversize in relation to surrounding properties and the parcel has full width street frontage at both ends. Section 2: That the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, which is possessed by other property owners under like conditions in the same zoning district, since the proposed size and configuration of each lot is consistent with surrounding lots in the same zoning district. Section 3: That the granting of the variance would not be materially detrimental to the public welfare or injurious to properties and improvements in the surrounding area, since each lot would provide adequate area for devel- opment of a single family dwelling and the creation of an additional lot would not adversely affect surrounding views. Section 4: That the granting of the variance is contrary to the General Plan since it is the policy of the City to prohibit future residential develop- ments from providing direct access from individual units to arterials and the granting of this variance would create a direct access to Palos Verdes Drive East which is identified as an arterial in the City's General Plan. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby denies Variance No. 53. APPROVED and ADOPTED this 28th day of April, 1981. 11,11P 011,3\* % Harvey Brown, Chairman 4LArncieA4K,47i4p4A.,/ Sharon W. ig tower Director of Planning and Secretary to the Commission
